i commissioned an artist on FA for a chibi back in june and paid upfront. they said that they might get it done quickly, which was a bonus but not necessary. however, now this artist is completely ignoring me, and... i'm not on their current list of commissioners, either. i've sent them two notes asking for updates or a refund, and they've been read/ignored.

in a situation like this, what would be the proper way to proceed? i haven't needed to post an entry to the community before, so i'm unsure if it's something i need to mention to the artist beforehand. for example: "hey, can you please let me know what's going on, otherwise i'm going to need to post about this on A_B". i really don't want to come off like i'm threatening them, but i really have no idea what to do to make them respond at this point. it's so awkward, because they were so nice, and they're active elsewhere... but i'd really like what i paid for.

As nice as they may be, they're not exactly being professional with you by ignoring your notes. So don't be afraid to write up a beware. Lack of communication is something to be wary of when money has already been exchanged.

I'd say perhaps you should try posting a public shout on their page where they're most active and ask them to respond to your note(s) regarding your commission. I'd also say go ahead and send them one last note letting them know that you need to hear from them by X date or you'll have no choice but to write a beware. 3 months of not even being put on an active commissioner's list is pretty shady. :(

I get what you mean about threats, it's tricky because they have your money. You'll have to put your foot down though an give them an ultimatum though if they're ignoring you. For example, you could say 'Please respond to me by -date here- or I will have to take further action.' Definitely mention how you're aware that they're reading your notes but not replying to you.

IIRC, you should still be able to file a dispute with Paypal to get your money back, assuming that's the way you paid.

Assuming you paid via PayPal, you should be able to file a dispute still as you have 180 days (IIRC?) from the point of purchase to do so.
If they are ignoring your notes, give them one final note that they have until X date to respond or you will file a Paypal dispute (and/or a A_B, however you want to go with this). You have every right to protect the money you spent and if they aren't responding to your inquiries, there isn't much you can do besides this.

Like some of the others already said, send a note again with an ultimatum till the commission has to be done (maybe 1 week) and then go the way over paypal to get your money back.

Do a chargeback, and if for some reason, they do the art (like they had a family emergency or something) you can always cancel it, or resend. Do NOT cancel the chargeback until you have you art. They can easily say 'cancel it! Im doing your art tomorrow' and never do it and you wont be able to dispute it again.
