I'm sorry, but I fail to see how your example is even remotely close to tracing. I'd say referenced, but the inner thighs being "in the same area" and the tiny spots of overlap aren't even close. That would be referencing. What the accused has done is flat-out tracing. Look at http://i42.tinypic.com/yyp01.jpg for example - i fail to see how referencing would get the spacing between the lines for the hips so exact. It's one thing to have one line that matches up, but two plus the spacing and proportions to match? I don't know about that.
