[identity profile] drakhen.livejournal.com posting in [community profile] artists_beware
Hi all, first post here!
I've had a helpful bystander email me this link to a site that contains four images of mine (signatures obliterated by cropping) and I was wondering if anyone might be recognising their own work being used here too as there is various dragon and other artwork being used.
I don't recall being asked permission for using my pictures but I've a terrible memory so that's not to say I was not asked. However there is no credit given to anyone specifically for any of the images.

I've emailed the webmaster to ask nicely for credit on my own pictures, but I could not speak for anyone else so if you recognise your work you might want to email them about it.

I wrote him a letter.....

Wow. That's all I have to say. I'm going to give you a smidge of advise since you are obviously very protective of YOUR copyrighted material as demonstrated by the screenshot:

http://members.vclart.net/Frisket17/1DragonPage.jpg

Now let me make it understood that pictures are copyrighted too... The person(s) you've taken from are not entirely happy and already this link has been mentioned on a few sites telling us of this art theft. (As that is what it is.) I'm sure you understand how long it takes to create something, be it stories or songs or art. It isn't pulled from the air and it takes time and creativity to make.

I'm sure if someone took your ideas and claimed them as their own without emailing you for permission or giving you credit, you'd be outraged I'm sure. This is the case in hand. You are using material not belonging to you. One of the artists is identified as Drakhenliche. Her artwork is found at:

http://elfwood.lysator.liu.se/loth/i/s/isabelle/isabelle.html
http://drakhenliche.deviantart.com/
http://us.vclart.net/vcl/Artists/Drakhenliche/index01-by-date.html

Just to name a few. In your pages you have completely shunned her right to her own work by not only taking it, cropping it, but didn't even put credit or ask her permission. That isn't right, is it?

I'm asking you on a personal note if you really value protecting matieral (such as your own) you'll remove the artwork that isn't clipart.. The stuff drawn by artists at Elfwood, Deviant Art, and VCL (and other private archieves) were not meant for others to simply take; much like your stories.

Eitherway, that's my little thought of the day. Feel free to respond when you've a free moment.
Thank you for your time,

Melissa O'Brien of VCL and DA.

Their Reply:

I did not 'steal' a thing every picture on that site save for the few drawn
for me came from several of the free sites online you get when you search
for 'free fantasy art' take it up with them, you are not an artist. If the
artist contacts me with proof that it is their artwork, and asks me to
remove it I will.

Since none of them apparently have the backbone to ask for their rights,
'mentioning it on various sites' but not bringing it to the attention of the
easily noticeable posted contact then that is not my problem.

That's [livejournal.com profile] neondragon's. I'd recognise that style anywhere. She's a pro, so I know she's not just giving out her stuff to be cropped the crap out of.

No, dumbass, it is your problem. As the designer of a site or any publication of any kind, it is your responsibility to secure the rights to any material used within it. If the material you use is supposedly clipart, then it is also your responsibility to make sure that all the material you use within it is royalty free which is to say that it is not bound by a copyright and is intended for use in the ways in which you intend.

If any piece of the material you blithely post as a part of your publication is not royalty free, it is also your ass on the chopping block of litigation should someone decide to sue you.

In short, it's in your best interest to stop acting like a prick and find out what materials you used may not be copyright safe.

That is all.

...this jackass probably plagiarised (should that even be past tense?) in his high school papers and thought nothing of that either.

In either case, I'm a Graphic Designer, I know very well what a publication's responsibilities are in terms of securing the rights to work used within it. 'I didn't know,' is not much of an excuse. He's bound to responsibility for finding more reliable sources for 'clipart' in any case, and if he continues to asct like a prick about it, and I were the original artist, I would sue the asshole.

Oh I know! In Web Design class, they said if you misused a logo and tried to create it (even if you NEVER saw it before) and it's already been done, you could be sued out the ass... Budweiser (sp?) did that to some kids who used the same font to make paraody shirts for the Beer. O.o;;

Frankly if I were the artists, I'd take his ass and hang him by his rectum.. But I'm just a bitter bitch who can't stand people who not only don't respect rights of artists (and then demand respect for 'their work'.. HYPOCRIT :P ) --- or even when requested snap back trying to make excuses.

He should be sued if he doesn't remove the images... (is cold, wet n' pissy. Ignore my mindless rants ^_^ )

It's up to you...

...if it were me I'd provide the proof, then force him to take it down on general principle for being such a jerk about the whole affair.

If you want the credit, however, I would find out just what 'credit' from this guy entails... will he post a link to your work? Perhaps an e-mail so that other like-minded right-click junkies think twice about stealing the stolen work to post on their oh-so-cool website and maybe ask you first?

Just remember, he's the one who's obliged to cater to you in this particular situation, not the other way around.

-giggles- No problem. I look out for artists as I know people look out for me.

Frankly I'd tell him to shove his ..eh. Bits in a light socket but that's namely because he came off as horribly rude. You're calmer than I. I just thing the biggest hoot was how he said I WASN'T an artist and should shut up. (to paraphrase.) ..

Huh. If I'm not an artist, guess I pulled my own 'pretty pictures' from my arse C_c;;

But anyway. ^_^ G'luck on dealing with him. Just remember you are not obligated to him..He's in the wrong.

If someone truly valued my work that much, it would appear on the site, but I guess it's not worth enough.

But I do recognize some stolen cover art from a couple Elric books on the site. His pilfering knows no limits.

But to quote the email he sent me, that art was all clip art and/or was 'gifted' to him. -cough- O_o; Yea.

I would counter that- if someone truly valued your work- they'd take the time to credit you for it before posting it on their oh-so-cool website.

And even if 'they didn't know' where it came from they would either find out whose it is (requires effort) or have the decency to not post it on their site (requires a conscience).

Theft is not the only crimes this chap's commited if you ask me, let's add sloth to the list as well.

Anyone who want's to get around those dumb "right-click disables" or such... use the View > Source on your toolbar and you can view the actual html in txt format. You can snag website text and URLs to images this way.

I like using Galeon. In the top bar it's got a simple little button for disabling javascript and java.
