[identity profile] oceandezignz.livejournal.com posting in [community profile] artists_beware
We're aware of the post by [livejournal.com profile] jalmu that has been locked down (comments hidden from community) without our permission. Unfortunately we cannot undo it as LJ doesn't give moderators that freedom.

Jalmu has been given a grace period to fix this.

Thank you all for contacting us about it. We appreciate it very much.

Not exactly making her side look any better, is she?

I think more than anything else it just adds more of a beware against the person. First their shady ToS, then the self-modding. Now the removal of discussion. o.O

Sucks it can't be unlocked. Hopefully someone got a cap from the comments.

I got some bad vibes off that post, it really read like Jalmu was stealing that commissioner's money and wanted to be validated because they talked to "some lawyers," another fact I highly doubt. If a lawyer tells you that you're allowed to cancel and keep the money for services not rendered your next call should be to the bar association for your state because just no.

I'll just repost what my own lawyer said: A vague ToS does not allow you to cancel a service and keep the money when you did not render the service. (He also said if you have a vague term like "harassment" and what harassment constitutes is not defined in your ToS, the court will go with the dictionary definition.)

It's definitely not looking good for the poster and I also wish I got screencaps of the comments especially any with the OP. So where does this leave us? Is it now a beware of the OP?

Wow, didn't see that coming. Will Jalmu be banned from AB for doing that?

I hope so; she's been warned several times in her post alone to stop freezing comments and self-moderating.

I think a beware can be compiled from screencaps of comments from the message center, as well as her post (as I can still see it just not the comments). :x

Blocking on all accounts FA/DA.

Ughhh so she's basically deleted the info that calls out her ToS and everything as well. That's incredibly shady. :|

And I was on her side up until this point too. Why would you lock down those comments unless you felt you did something to be called out on?

May I suggest two things? One, that you include a link to the comm post [livejournal.com profile] jalmu locked without permission, and two, that this be tagged also as a beware on Jalmu. I'd also like to see the archived posts that Jalmu deleted/locked/turned invisible connected to this post.

This sort of behaviour in the community is, to my mind, sufficient reason alone for a beware. I know I have no desire at all ever to do business with her now. A shame, because she looks to be a very capable artist, too.

I'm a little iffy on tagging this as a beware against jalmu myself because our bewares are generally based on one's conduct in a business transaction, and while misbehaving in our community gives a bad impression I'm not entirely certain if it would come off as a professional thing for us to do. Jalmu has been given a grace period to comply with our request to revert the post to its original state, once that expires we'll see.

Unfortunately we do not archive advice posts, only bewares. So unless anyone else took screencaps there is no record of the post's comments beyond the email notifications we receive in our inboxes.

I actually thought about that for a bit. At the same time, throughout that post she did reveal what her conduct during a business transaction is like. The vague term of harassment giving her the right to (essentially) steal someone's money seems like grounds to post a beware.

I read through most of the comments and I didn't see ANY of this 'aggressive' commenting she mentioned. I saw people disagreeing with her TOS, but in a civil manner.

Makes me wonder if this client is really as harassing as she says.

That was my immediate thought. If she thinks polite discussion was mostly "negative/aggressive comments", what was her customer doing? She already admitted that the supposed-slander was him going around saying "she is taking people's money and not giving any art in return".

I hadn't looked at the post for several hours (and just kind of stumbled back since I have scarcely anyone on my f-list), so not sure if anything else was posted.

However, the last comment I saw was a user stating their father, who's an actual attorney, called bull on the idea that not giving her client's money back is "legal." It was completely mild and polite, just to the point and likely not what Jalmu wanted to hear.

I think the comments would be a valuable addition to the archive community, seeing as how most people were telling her "No you can't keep money because the customer was irritating" nor did people think it was okay that she figured that past art made up the difference somehow.

I didn't see any "aggressive" commenting either.

Aw, she couldn't handle being told the truth, it seems.

I'll be avoiding doing business with her and her awful TOS, that's for certain.

Yeesh! For someone who supposedly claimed she was going to change her ToS, there was nothing that was. Her statement of "harassment will void refunds" is still there. Unwatched.

Oh, so that's probably why the post was locked then.
Shame, but it makes for an excellent beware on their part. D:

Forgive my ignorance, but which post was this? Or by locked down do you mean that it's no longer visible since I don't see it?

It would be this one. Lots of folks telling her that she can't keep a person's money even if they are "harassing" her.

You have to be logged in and a member of the community to see it, that's why I didn't notice it at first.

Yeesh... I sense the banhammer a-comin'. I doubt that they're going to fix this, considering they don't seem to want any criticism. :/

Question for the mods

I wasn't aware we were able to self-moderate posts in this community, so I assume it went along with some of LJ's recent updates. Is this something you guys can turn off? Or are we gonna have to look out for this in future cases of "I don't want any criticism!"?

I don't believe we can, unfortunately.

But we are discussing the level of discipline for this specific case.

Unfortunately LJ gives powers to OPs that community moderators have no control over.

Aaaaand... the post has been deleted...? That wouldn't be the mods, I don't think? But if the OP was banned (per later post from the mods), it couldn't have been them that deleted it, either?
