About 4 months ago I posted on here about trying to get int ouch with Gideon and another artist. The situations with the other artist got resolved and Gideon got in touch with me; since then however I've heard nothing from him.

Back in September 2007 I commissioned Gideon and now more than a year and half later i've still not even seen so much as a sketch.
I've tried sending him emails, private messages on LJ and FA and i've sent him messages on AIM. The only time i've managed to get his attention was last time I posted on here.

Gideon, please get in touch with me!
At this point, unless you've actually started work on the commission, i'd rather just take the money back and leave it no hard feelings.

From my personal experience, he rarely answers emails, but from what I've noticed is he pretty much only finished commissions at cons.

Your best bet is to just go to a con that he goes to. He always goes to the ones I go to, and just refresh his memory.

A customer shouldn't have to go out of their way to travel if they've commissioned someone. Frankly, he should be able to respond to emails if he is going to do take-home commissions or commissions over the net period. :/

I agree with this. The artist should either do em at home or do them at cons only. I, personally am -not- going to commission someone and then TRAVEL ANYWHERE to simply give their bleedin' memory a jolt of what's owed to -me-.

EDIT: And yeah... definately would be taking my money back after that... >.> Keep pushin' for it! *cheers*

What! You think that is a good idea? You think it's a good idea for a customer, who has paid for their artwork, to travel to a con which would cost them more money, just to remind the artists that something is owed?

Based on my experiences with him, you're out of luck. He has a long history of taking comissions and then not completing them, so I'd basically consider the money gone. They only way to get him to do anything is to pester him constantly, and even then he'll likely half-ass out a picture that's significantly below his normal quality.

May I suggest, if this post does not work, filing a claim with the Better Business Bureau. I've found it to work wonders. And even if it didn't, leaves a good mark. Couple of those and no business by he shall be had at all.

I've received art from Gideon without any problems, though admittedly at a convention. Also he doodled something for me once when we were chatting in one of those chat/art-combo programs, but that was a while ago. Like years ago.
I haven't spoken to him recently because he's so swamped with work, he might be accepting too much work but I don't have the insight into his personal life required to express an informed opinion on that subject.

Oh I know how being swamped with work is. Commissions on top of a regular job where we're understaffed at a peak time of year (economy woes my ass, people are going to theme parks like crazy wild right now x.x) - I don't doubt he's got things to do, but you gotta finish what you start, eh? I mean I often see or hear (from friends and/or here) about him and I'm just kinda figuring that there should be some sort of warning that you're better off getting it while you can 'watch' him or save your pennies for others.

If you are like selling a service, then you like have one. Guy does this for a living, goes to cons, maybe advertises...

Filing with small claims court is another option.

I can guarantee you that this guy has not joined the BBB. I would bet money that he doesn't even have a registered EIN.
Also, art is not a service, it counds as merchandise/goods. Services are things like utilities and bus lines.

Without a legal leg to stand on, not even a contract, rather irresponsible thing to do with one's money then. Genius for the artist though. Hm.

Transactions of this nature are always risky. It's up to the consumer to do their research, hence communities like this.

Besides, just because a person isn't an official business or doesn't have a conract doesn't mean you can't take them to court. It's just a matter of whether it's worth all the time and potential expense to take someone to court over $50 or however much.

Considering that this guy seems to do quite a lot of monetary transactions for services...It might be an idea to threaten to tell the IRS? I'm not sure if in the US it varies from state to state or what the amount is, but I doubt this guy is filing taxes for any of what he makes in commissions...if small claims court is not an option...then I would probably threaten to tell whatever tax revenue service is responsible for his area.
