I was recently in an art trade with someone who was going to write a story in exchange for me doing art. He finished his story first and as I read it, I saw that the character names he had chosen, Reiko and Janden, were often replaced with Greta and Horace. I questioned him about it, and he admitted that he had pasted together a mish mash of previous stories he had written for his half of the trade.

I spoke with a friend about this who said I should post here. But that I should finish my half of the trade despite this, so I would "come out smelling like a rose." I don't feel I should be obligated to do this as he didn't actually write a new story.

I am unsure of what to do at this point. Any helpful advice would be much appreciated.

at this point im super annoyed.

her excuse last month promising the commission before Jan was over. How could mine not get done when she posted random art and other commissions almost every other day? (view her gallery for more dates): http://tinypic.com/r/aka5np/5

message I sent her a week ago never opened when I see she leaves comments on others daily so I have been ignored: http://tinypic.com/r/mbidsj/5

So i decided to email her, it took a week as well to get the email response. And it was not a very nice response either. She talked to me as If she would be doing me a favor putting my art with her Christmas art...when my commission was supposed to be a gift in OCTOBER that I told her about multiple times, and she continues to ignore that acting like its a HUGE favor to allow my commission to go with over due Christmas art. She also previously gave me multiple due dates and such as listed above, NO progress images were ever given. Personal art and other art continues, but my art once again was the piece that magically vanished with her computer issue story.

I know most artists don't handle formal contracts for commissions, and for non-commercial work, I do tend to feel that a good ToS is sufficient. For commercial projects though, or private commissions involving larger sums of money, I would feel a lot better with a signed contract with specific details pertaining to the project at hand. But signing contracts with people all over the country and internationally can be difficult when 1) no one uses fax machines anymore, and 2) not very many people know how to utilize Adobe Acrobat's digital signing capabilities.

Is there a better way to deal with it other than mailing out two copies of a signed physical contract, having the client sign them, and then having them one mail it back? Or having the client print, sign, and scan the contract? The former has a long wait time and a lot of hassle, especially if the project happens to be on a deadline. The latter requires the client have a scanner.
