To aleuuzy, politely send the artist a screencap of the email which had his/her agreement not to do the art until you were ready to pay for it.

I replied to this when it was first posted. I don't remember my exact words, but here's an approximation:

What you need is a screencap proof of him agreeing to the transaction. It goes against his TOS so perhaps he didn't remember agreeing to your deal, so proof might set the record straight in your behalf. In the future, perhaps you should commission artists whose TOS fit your needs instead of asking someone to change their practices to suit your needs.
