Hi all! I'm just putting a warning out about SheezyArt and it's submission agreement:

From SheezyArt's submission policy:
"I. Right and License

You grant to SheezyArt.com a non-exclusive right and license to:

(A) Encode, digitize and store the Submission indefinitely..."

And of course, my favorite bit:

"XI) Stored Media

You understand that SheezyArt grants each artist the ability to remove his or her stored media from view of the general public. However, we reserve the right to privately retain such media on any site facility indefinitely for reasons of site security and review by our staff."

So in other words, I cannot ever fully remove my work off of their site. After 'deletion' of my images, they still retain the rights to my work and will not fully remove it. And everyone is alright with this?

I strongly advise against getting an account there.

Arcturus also wanted to port the old Furaffinity database to Bitchplz Artplz, something the artists obviously hadn't given permission for when they signed up for the old FA.

Considering that Arcturus and Channelcat (from SA) are friends and considering both their histories I wouldn't trust either of them any further than I can throw their fat asses.

I haven't used SA from the start cause I was very skeptic about furry archives. Now I'm glad I didn't. It's basicly 'legal' theft.

I haven't used SA or FA, and only signed up for DA mostly for comments. (And I think I posted one or two pictures there.) *shrugs* They don't seem like very good or well-organized archives, IMO. I like archives/"galleries" that are easy to browse and those ones just don't seem to browse-friendly to me.

I have a Sheezy Art account, but I really only keep my junk art on it. Everything else goes to DevArt. :/ It's really just a seperate account for all my junk.

What's the difference of them storing images privately versus me wandering accross an image and saving it to my HD? There's nothing mentioned about the ability to repost or to usurp your copywrites, so there's very little here that would lie outside a traditionally legal domain. Do you think if an author wants to discontinue their work that the press company does not retain a copy on file?

I don't really see anything 'bad' here--it's only bad if they use your images, repost them, etc.

I agree with this personally.

Deviantart does a similar thing, except from what I know, they store it for a certain time before it is eventually permanently deleted.

I can understand that they need to store files for a "just incase" type basis.

I doubt SA would want to do anything with anybodies artwork..expecially after the original artist deleted it from public view.

Unless the image is deleted by an administrator, all traces are removed permanently after a week from DevArt's servers.

My friend tested that, and her deleted picture remained on DA's servers longer than a month. They did eventually delete it, but it took longer than a week.

The difference is that they still retain the right to use your work to promote the site, even if you've closed your gallery there.

"(E) Use the name, likeness, voice and biography of you and/or any person rendering services in connection with the Submission, in connection with the promotion and advertising of the Submission or its related rights. However, you understand and agree that SheezyArt.com is under no obligation to display, reproduce, or distribute the Submission and may remove the Submission from SheezyArt.com at anytime without notice."

That, and ChannelCat really is a questionable person.

Without that bit, they wouldn't be able to place the submission in your Gallery page, since essentially your gallery page promotes and advertises your Submissions. This allows them to make the thumbnails out of your image and feature it in Recent Uploads and the search feature. Nowhere does it say that you're giving them the right to promote SheezyArt with your art or anything of that sort. You're only giving them the right to promote YOUR Submission.

Yeah... I left because of something else questionable they did. Channel Cat (one of the main mods) apparently hacked into FurAffinity in a fit of brattiness after they refused his help in recoding the new FA.

I don't know about you, but I',m definitely not staying in a place that condones such behavior.

I'm not sure to what extent Channelcat hacked, it looked like Arcturus did all the hacking and Channelcat was just his buttbuddy.

*sighs* Yet another case of people getting jumpy about legalese.

You have to grant a site the right to encode, digitize, and store your submission or else they can't post it in your gallery in the first place. DeviantArt had this same policy and explained it quite clearly (http://dygel.deviantart.com/journal/5006532/ ). They don't take away ANY of your intellectual property rights. They merely need to include this section because they need YOUR permission to allow you to upload it to your OWN gallery there.

Also, when they say they "we reserve the right to privately retain such media on any site facility indefinitely for reasons of site security and review by our staff," that doesn't mean they're going to do it each and every time you delete something. In fact, I'd suspect that they DON'T save it on the server most times, but they still need your permission should the need arise. Why would they ever need to save your art on their server when you've deleted it? Mainly for legal issues.

For example, let's say someone uploaded a picture that included actual threats violence against another member of the site. People got upset and contacted the police (for whatever reason), but the person deleted the picture before the staff could see it or do anything. If Sheezy didn't have the right to store the picture, there would be no way for it to show the picture to the police when they asked for proof of this threat. That's one reason I can think of for them needing to include that, anyway. No, it's not going to be a common occurance and it probably won't even happen, but they need to include it so if that sort of thing DOES happen, they won't get sued for copyright infringement for showing the police the picture that made serious threats.

Does that make sense? I just really REALLY wish people would think about these sorts of things before getting paranoid and telling everyone to delete their accounts off of whatever website. I personally wouldn't recommend Sheezy, but that's just because I think it does a crappy job, not because my rights are in any danger.

Thank you =3 You saved me a butt load of trouble trying to explain that *lawls* I don't do much on sheezy any more just because they went back on their word and no longer allow 'adult' submissions. I mostly post on Y! Gallery sence I mainly draw males anyway, and occasionaly if I do draw a female I'll pop it up on DA.

No problem. :) I just like to try to make sure that people understand things correctly before they decide on things. And yeah, I lost a good bit of respect when they went back on their word, too, even though I don't personally draw adult art. It just seemed like poor taste to promise one thing then go back on it to turn into DevArt Lite.

I don't really either ^_^'' I've done a couple peices but that was after I left sheezy, I do some nudes occasionaly, just for anatomical practice or what not but yeah, I mostly left because they were all "leave DA, come to SA cause we will let you post nudes and adult art." And then suddenly they put out a notice that everyone needed to remove those sorts of submissions from their galleries or they would do it for them... Bah.

It's all pretty standard legalese for an artwork gallery. They COULD do a better job detailing what exactly they will do with such 'permanent copies'.

One OBVIOUS reason is backups. Any good site will create backups of the database onto tape or some other cheap long-term medium. If you delete an image from your gallery, do you really expect them to go throgh ALL The backups and delete the image from there, too? That would be insane!
