WHEN: Payment was owed on the day I started the commission in mid-December. When payment was requested, the individual claimed payment had already been sent but would not provide transaction IDs and then stopped responding.



Before I go any further, I wanted to acknowledge that I know I'm to blame for not sticking to my own TOS and I've since been a lot stricter about it. I felt that while it really is my fault for uploading the picture without confirmation of payment, that it might be a good idea to get this beware out in case he tries to pull the same thing on someone else. Anyhow, here's the story! I've got screencaps of the conversations we had in notes below, just so you've got something other than my copypasta to go off of. I hope the formatting is ok and everything's organized all right for you guys.

So, my commission system works like this: My commission queue is actually a waiting list. I don't give out my paypal or ask for any money until I'm ready to start the picture for whoever's first in line. Turnaround time is 1-2 weeks, depending, but sometimes it's same day (I gauge how much time I'll need to allocate for the pic based on what the commissioner wants). This way, the commissioner gets the final product quickly after paying for it.

Another reason for the waiting list is so commissioners can bow out if needed before any money is exchanged and I do any work. I list work-dates, when I expect to get to a commission, when it was mailed, etc in my journal footers on FA and let commissioners know that they can check it for progress reports. After I finish a commission, I contact the next person in line and ask if they're still interested. If they are, I provide my paypal and request payment. Repeat ad nauseum.

Geimhreadh contacted me in notes after participating in one of my weekly contest streams (I hold a drawing weekly where a random winner is selected to get a free drawing). He had asked during the stream about a commission, and I'd directed him to my commission info journal located here: http://www.furaffinity.net/journal/2831380/

He became a regular on my streams, so we would chat quite a bit while I was working on other commissions and the weekly freebies. Then, it was his turn.

Geimhreadh's note (received on the day before his commission's start date. Normally I try to note people two days before but I was a day behind that week): Hey Vinci~ Is Gummy :D

Looks like i am next on your list and wanted to contact you :3

My response: Hi Gummy! Yes you are! I was going to note you today. :D I'll be starting yours tomorrow! What would you like?

Him: Hehe a pic of my Chimera character sitting on a rock with an excited face with his tongue out, dressed in black pants with a wallet chain and a blue and pink striped hoodie hood down. Hope i get to watch the stream if you do one tomorrow :D

Me: Okee dokee! I can do that! A full color single character pic comes out to $30, and my paypal addy is omitted@omitted.com :) One more thing, can you resend me a reference picture of your character?

Him: Okay :3 I'll probably be able to send pay by end of week :3 i get paid wednesday.

Ok, here's where I made my mistake. I normally don't start the picture until payment is received, but I figured, OK, Geimhreadh is a regular in my streams, we're pals and all, I can just go ahead and start it. So, I began working on it during my stream, and ended up finishing it in one evening. Geimhreadh showed up, watched the picture being made and seemed pleased with it. I asked about payment during the stream and he mentioned in chat he would send the money right away. Again, I made a dumb mistake and uploaded the final without confirming that the payment was received. I knew deep down it was a bad idea but again, figured the guy was a regular, and worst case, I could just poke him about it during the next stream, right?

WELP.

A week later with no payment in sight, I wondered if Paypal had boffed something up and sent him this note:

Hi Gummy,

Just letting you know that I haven't received the payment yet for the commission from last week.


His response: Oh right o.o sorry i forgot with the holidays and all. Ill send it right away!

A couple days later, I didn't see it yet, so I sent another note:
Hi Gummy,

What name would the payment be under? I want to make sure the transaction is going through ok, as I haven't seen anything come through yet. Thanks!

His response: Should be under OMITTED sent it yesterday morning.

Me: Yeah, sorry, I don't see anything by that addy. :/ Which paypal address did you send to?

This note was read but never responded to, and Geimhreadh suddenly stopped coming to the streams. Ok, now I was pretty sure I was getting stiffed. I waited another week (3 weeks after payment was due) and sent this note:

Hi Gummy,

I still haven't received payment from you for the $30 commission and I haven't heard back from you. My TOS states that payment needs to be received prior to the picture's completion. If I don't hear back from you with payment information I'm afraid I will have to post a warning to artists_beware.

I hope this is just a misunderstanding!

His reply: I sent it to you :/ i got a notice from my paypal saying it was sent.
And i currently dont have any more money to give out im in debt >.< my bus trip to AR sent me into the negative 400's in my bank account.
i can try again asap.
terribly sorry for this >.<

My response: Which paypal did you send it to?

Him: The one you sent me in notes. :/

Me: Ok, do you have the transaction ID?

That was the last note, and it has been read and ignored. He no longer shows up in my streams, which makes me think this was deliberate and not just a Paypal misunderstanding. Plus, the notes show he's aware of the price and how my queue works.

The part that kinda steams me the most is that he was there the night I did his commission and saw just how much effort went into it. That, and I have that weekly freebie thing I mentioned, so if he wanted a freebie he probably would've won one eventually anyway (I've since removed his name from the list of entries. If he pays I'll put it back).

Anyhow, lesson learned. 1. Stick to your TOS, even if it's a livestream buddy, and 2. Just coz' someone's nice to you in a livestream chat doesn't mean you can trust them. Like I said, I know where I screwed up, but figured I should put a beware out there for anyone who may get a commission request from Geimhreadh. Get payment up front!

I /really/ like the way that you lay out your commission schedule and think that it makes quite a bit of sense. I may incorporate something like that for myself soon enough.

I'm sorry that you got screwed :c I actually remember being in-stream when that person was there. Hm. I never would have dinged them for a scammer, either! Lesson learned and duly noted, I suppose.

I've had customers type the paypal wrong where they send it to and paypal still sends the payment as if it were correct. Paypal keeps that money in limbo until they ask to refund it. (I have no clue why paypal does that, it's dumb really) It's happened to me on more than one occasion as well.

But still that's kinda screwed up. :C

Though you can be out of luck if the wrong e-mail address you typed actually belongs to someone with an active Paypal account. Then you're into dispute territory and I'm not sure how Paypal would handle it.
