[identity profile] sintocat.livejournal.com posting in [community profile] artists_beware
WHO: SoraKitty

WHERE: http://www.furaffinity.net/user/sorakitty/

WHAT: Entered an art contest with the prize being $50.

WHEN: around 11 months ago. The journal http://www.furaffinity.net/journal/2383472/ (it says waiting for mine but she never updated it.)

PROOF: http://www.furaffinity.net/journal/2383472/ Journal with the entries
http://www.furaffinity.net/journal/2527594/ - she moves out.
http://www.furaffinity.net/journal/3035986/ - she comes back after around 6 months. Says she'll post the winner in Feb.
http://www.furaffinity.net/full/5897474/ - my entry
I've sent her countless notes all of which have been read and unanswered.

EDIT(4/17/12)
Screenshot of comments on my submission(requested by mod) http://i.imgur.com/YtkFv.jpg
Screenshot of her original journal http://i.imgur.com/uylyw.jpg
Screenshot of journal saying she would choose a winner in February http://i.imgur.com/ieBgP.jpg

EXPLAIN: I'm not exactly sure how many art entries she had for her contest but I know it was over 5, but even if only 2 people enter you need to be able to pay up if you have a contest. As of now she hasn't paid anyone. I noted the people I knew actually submitted art and asked them if she may have personally told them they won and paid them then - but none of them were contacted. At this point she is active and does not seem to be willing to finish the contest any time soon - considering she's ignored my notes over the past years. They have been all basically the same thing, but here is the most recent one -> http://i.imgur.com/R3l7H.png

I'm not sure what can be done when she wont respond to my email - for all we know she could have chosen a tattoo design already and had it done without paying anyone :/

EDIT (4/17/12)
I would also like to make it clear that I'm posting this because several people, entering a contest assuming one person will win and get $50, saw no results. This is a warning so people can be careful about entering her contests in the future.

Approved, but I would recommend taking screencaps of all of the journals and SoraKitty's comments in your submission.

Ah... I thought that username sounded familiar. I somewhat know her irl, though not very well. She's come to a few of our local meets.

I have her added on Facebook -- I can try messaging her and directing her here, if you'd like? I don't know if it'll do any good, but if there's a chance of it helping you get what you're owed, I'd be happy to try.

Is it possible she didn't get any entries she liked enough & never got the tattoo? Not really an excuse for welshing on the prize, but maybe that's how she's seeing it.

Exactly. I entered a similar contest for a tattoo based on a very vague description. What I drew wasn't really what the person was looking for but I was the only person who entered her contest so I still won a year of paid LJ by default.

If she never announced a winner... then maybe there wasn't one. I have to be honest, it seems a little conceited for you to post it here, or, well, maybe that's just how I'm seeing it. I'm pretty cynical sometimes.

If you weren't contacted as a winner, then it's likely you weren't one, and it's not really any of your business unless you see her post a picture of her new tattoo, and it happens to be your design. She's not obligated to give $50 to someone who made a design she doesn't like, considering the whole point was for one to be one that she liked. :P

Yes but the she could have answered and told her that no, she hadn't won. From what it sounds like, the OP only wanted to know what's up because it hadn't been updated.

Even if she didn't like any of the designs, she does have to pick a winner and pay them, she just doesn't -have- to get a tatoo of it if she really doesn't want to. If this were just a "comment here and you might get a pic" contest, then no, you aren't all that obligated but people spent their time for this contest. It'd be the same thing if people had paid to be in it and time is wroth money. She essentialy got pictures for free at this point and personally? I would like to know that I shouldn't join in another of this person's contests if it were possible she'd just turn around and say she doesn't like any and too bad for us (if this is the case).

Hopefully she did actually pick someone and just chose not to answer the OP.

She's not obligated to choose a winner either, frankly, especially if she didn't like any of the designs. No one was guaranteed payment for anything. You enter a contest knowing that you may not be chosen a winner and knowing you may not be compensated for your work.

Perhaps she doesn't want to answer the OP because... well any number of reasons. Maybe she, too, thinks it's conceited of the OP to demand to know who won, or she hasn't chosen, or she hates all the designs, or she doesn't check her notes, or whatever.

It doesn't really matter either way.

It *would* be nice to say "Hey, there are no winners, sorry guys," but she probably feels like she'd get beat down for it by more people than if she just keeps quiet on the few that entered.

Well ya, everyone knows they may not win but you do go in expecting one person to win.

How is she not obligated? If you enter a contest, where you offer your time/skills/money to enter, then there needs to be one winner, even if you don't like any of the submissions. That's like saying that if you do a trade with someone, so offering skills/time instead of actual money, you don't have to do your half just because you don't like it (there is a difference between disliking something and the art being drawn badly in comparison to normal work. In those cases, I could see not doing your half)

This is basicly a scam otherwise, you pretend to offer a prize, get free pictures and then don't compensate for it. This is exactly why I personally don't enter contests, most of them are scams.

Now, if it were a "catch the previews/comment here" type of contest, then yes, I would find it silly to bug the artist about it because you didn't actually do anything to get into that contest, you don't lose out.

Hopefully this is only a misunderstanding and Sora did pick a winner but didn't want to reply to others.

If she doesn't pick a winner at all, it's no longer a contest, by definition. It technically becomes a form of gambling, which makes the situation both ethically and legally sketchy.

Either way, reading her original journal, she doesn't include any clause to warn entrants that she might not choose anyone, or really, what skill level entries need to be. She just uses a very nebulous "[y]ou need to draw a good picture of my fursona."

This is still very shady. I posted an experience to an above comment:
"I entered a similar contest for a tattoo based on a very vague description. What I drew wasn't really what the person was looking for but I was the only person who entered her contest so I still won a year of paid LJ by default."

Even if the entries weren't what she was looking for she still needs to pick a "best in show" otherwise it's just a free art scam.

Speaking as an author, I never trust any contest where you give something and nothing is awarded. They're called scams. When submitting stories, generally you're offering time and effort following a prompt, but sometimes you're offering some money (generally, if you pay an entry fee, it's going to be a scam).

With artwork, you can essentially get yourself a free "commission" in this manner. From a slew of artists, all expecting to have the potential to win. So this could easily be a scam.

"If she never announced a winner... then maybe there wasn't one."

That's not how that goes, you hold a contest, you pick a winner, you give them the prize. If there's no-winner contests, anyone can offer whatever to rake in a bunch if free art and then go "Oh no, don't like it, I'll keep my money bai!"

then it isn't really a contest, it's begging people to throw free art at you and maybe they'll get a little something for their troubles

For your information I have chosen a winner, just didnt get around to posting it, nor will i. Too much time has passed.

I do not have copies of any of the submissions nor did i intend to keep any of the unpaid commissions.

I pay for each and every commission I have posted in my gallery and on my computer.

Also I love how everyone posted on here, yet no one else had the balls to come to me personally about it. Instead of talking behind my back say something to me.

Sinto I apologize for not responding, but I do not keep up with my FA notes anymore and am not as active as you may think. I get on maybe once a week but its only to clear out my submissions. I don't have the time for FA like I used to.

It is against the rules here for members to contact the person posted about unless they personally have a transaction with them. Hence why no one "came to you personally".
