WHAT: It was a stylized, SFW pinup of my character, Fen.
(emails/names that are appropriately blurred, PMs/Notes, IM logs, etc.). By conversation we mean the details hashed out between you and the Artist/Customer for said order(s).

WHEN: I am unsure exactly when I first contacted her but it was a day or two before payment was made. payment was made on the 10th of December 2012.
After seeing her put up commissions that were advertised after mine, I sent her an email on the 16th of February asking for an estimate of the completion time.
On March the 2nd I sent her another email asking for a refund if she was unable to do the commission within a week.
And on March 12th, I still had not got a refund or my commission.

EXPLAIN: I commissioned xk2x for a stylized pinup of my character and paid for it on the 10th of December 2012.

I realized something was going wrong when I had seen her submit commissions that she had advertised for after she had accepted mine and I decided to ask her for an estimated time of completion.

At this stage it was now over 2 months since I had paid for my commission.
She told me that she couldn’t give me an eta, but that she would hopefully have them done within the next fortnight.

At nearly 3 months (March 2nd), I sent her an email saying that if my commission would not be finished by the 10th of March, I would like a refund. She replied that she would refund my money.

On March the 11th (still not having got a commission or refund) I asked when she would have the funds to refund me and I now have to wait until Friday 15th of March to see if those funds come through.

I was refunded on the 17th :) finally!

Despite some people telling me that I should take this down now that its resolved, I'm not going to. I want people to be aware that this artist HAS stuffed me around.

She was at FWA this weekend which is why she probably hasn't gotten your refund quite yet since she was paid while at the con.

Knowing xk2x persoanly I'm sure it was a mistake. She's normally really good about these thing's! As skittles mentioned she is coming back from FWA which for her by car is like a day long trip, on top the fact she's a work aholic to support her self. It's no excuess for the work not getting done on time. I can understand the 3 month wait and posting a bewere about that is fine. But week over due refund right before a con for an artist can be hard. I'm sure if you contacted her today it would all be resolved now that the con is over.

The artist said they were going to be paid Friday the 15th. There's no excuse for the refund being later than specified, con or not. The artist should be responsible and timely in delivering the product in a reasonable fashion, or providing refunds when necessary (or promised).

THIS. If you are going to promise a date, stick to it. It's that simple. If not the artist should have mentioned they were going to a con and would refund as soon as it was possible.

Double agreed. A con is certainly no excuse. If you have to go somewhere, just say "hey, can this wait 3 more days? I have plans."

Really not that hard.

Yep. And even then, the artist obviously was aware of this con ahead of time. They had the means to plan for it, and I doubt it had any effect on the refund, given the tone of the emails and the mention of payday being on the 15th.

The con doesn't seem like it would have any effect, because the artist clearly mentions their incoming biweekly paycheck on the 15th when asked about the refund.

I'm waiting on a badge from her as well; I know she posted a journal saying something about how waiting might take a while because of a new job so she was also offering refunds. Right now I am hoping to wait it out and get my art since I do like the badges she is doing.

A bit ago I did a trade with her and it took almost a year and a good amount of pestering to get my half, but she did eventually follow through. So just keep reminding her I guess, hopefully she will come through with you refund.

I did a trade a very long time ago, so it's not quite valid anymore, but I didn't have a good experience either and needed to post here to get it resolved. Took about a year as well I believe? It's been a while.

This commissioner has been refunded as of March 17th. I'd be happy to post a screenshot of the transaction if anyone would like to see it.
I do apologize for this and would like to state that my intent is never to con someone out of their money. The last year and a half has been a rough one for me, and that's no excuse, but as I will always say, I can never make promises on deadlines, as my full time job needs to take priority, but if at any point you would like a refund on your piece, all you have to do is ask, and I will get it to you.
I'm sorry that Fen felt the need to post this.

It's good that you came forward to offer your side, and to make right to the commissioner. One thing really irked me though about your post: "I can never make promises on deadlines". That to me is a red flag about your work ethic. Your full time job is important, but if you are taking money in exchange for artwork, that is a job as well. You should find balance between the two, so that this doesn't happen again. If you're having difficulty keeping promises to your paying customers, it may be in your best interest to step back from commissioning until you can.

I agree completely with this. The circumstances causing the delay were unforseen as until recently, I was barely working part time. I have stepped back from taking more commissions and am working to get finished what I owe, as well as get refunds out.

I agree and I do apologize. I have stepped back from taking more commissions until I finish the ones I have, and really until I need the extra income again. As I said above, my hours changed from almost none to full time, so this was not something I could have forseen. I'm very sorry you were disappointed, but I appreciate your input on where I should improve. All of this will be noted if/when I open again.
