WHAT: A character auction I held in which she placed a 30$ bid. A couple hours later she posted a journal asking for a 50$ donation to pay for a vet visit and medicine. Upon seeing this I felt very uncomfortable with the fact that she was bidding in my auction with a sick pet she can't afford to take care of it- but I let it go, hoping that she'd get the medicine for her dog, and then come to her senses and realize that if she can't pay for her dog's medicine she can't drop 30+ bucks on a character either. Instead, someone outbid, and she bid again- this time 45$. And although someone did indeed donate the money for her dog, it still struck me as odd that'd she'd be willing to put down almost 50 bucks in an auction when a day or two before that's exactly what she didn't have. I had seen her paying for other art and adoptables too around the same time, so in general I was starting to feel pretty uncomfortable about the whole thing.

I came here for advice, and the general consensus was that I should cancel the auction or retract her bids. I did the latter. On her journal asking for donations, I commented to let her know I would be retracting her bids:

"Hey tooth- Thank you for your interest in my auction, however, given this journal about your dog needing veterinary care, I cannot in good conscience accept your bids in my auction- sorry. I hope he gets better soon!"
She responded saying that she had already taken care of the dog situation "but okay", and I thought the whole situation was over and done with.
It wasn't.
A minute later I got a very defensive note in my inbox from her which I had intended to respond to...until I saw her bid in my auction again, disregarding the fact that I had asked her not to. At that point, I hid her comment(again), and blocked her.

WHEN: 2/23/14 - 3/18/14

PROOF:
Emergency commissions for her dog, along with my comment(which she later hid) and her response.
Her bidding again, and my response prior to hiding it and blocking her.
A follow-up to her Very Tasteful Journal

EXPLAIN: This person has rubbed me the wrong way for quite a while. She is infamous for begging for money on FA, while dropping money left and right on adoptables and art and owing people art in the meantime. Her business practices are seedy and her attitude is very immature and unprofessional.

In short, even if she did have things "figured out", even if she is getting money in a few days- I do not want to do business with someone who puts buying art for herself before refunding commissioners to which she always owes work/money/etc.
---

I wrote this beware sometime that week, but withdrew it because I wanted to let it go. Someone did end up buying Dander, earning a colored sketch along with it because the auction went past 50$, and it was over.

About three weeks later, I was linked to this submission of tooth's brand new character...Dander.
Apparently, the user who won my auction had traded Dander to her in exchange for art(even though she still owed art to many folks already), and to be honest, I feel disrespected on many different levels. I feel like in the end it wouldn't have mattered if I let tooth buy this character, it wouldn't matter if I hadn't blocked her. She got her way anyway, and my art, along with a character she knew I didn't want her to have is now sitting in her gallery.

The whole thing leaves a bad taste in my mouth, really. I don't want Dander back. What I do want, is to let other people know what kind of person Tooth is so they don't have to go through the same thing, because at this point, I feel drained and taken advantage of.
I would advise against strongly giving her your money, your pity, or your business until she learns how to get her priorities straight and handle things like a mature adult.

(sorry about the last one mods! I had added all those links when I wrote the original entry because I wasn't sure if the bidding was enough! I should have removed them before i added on /)w(\)

This, you might want to fix the link. I got confused at first and unwatched the wrong tooth.
I was watching both, but now just watching tooth without the .

There's a few people who couldn't have a name they wanted so they made the same name with a . at the end and it's so confusing and aggravating, but that's off topic lol.

Did the person who won the auction (not Tooth.) know that you were uncomfortable giving the character to this person?
If they did, that's super shady and kind of warrants some sort of warning. That made me pretty uncomfortable that it went behind your back :(

Honestly wondered that myself -- Or how/why they'd just randomly trade something away they bid on. Sort of makes me wonder if they contacted the person to bid on the item to get around it all.

Having your things "taken care of" is not done by begging for money. What an awful aggressive note to send someone.

-watch, that is so shady to get someone who won the character you were denied to give it to you for art, especially when you owe art to people already and are begging for money for a vet bill which for pets you have no business owning. Unprofessional, shady, rude and unable to prioritize.

Jesus. :|
Got nothing to add but I appreciate the warning!
I'm sort of shocked at the gall of going around you to get what she wanted. In the future, do you think it would be acceptable/wise to add a disclaimer that no reselling/transfer of characters permitted without consent from you? Or do you think that's micromanaging too much?
I've never done adoptables or the like, so I'm fairly inexperienced with advice on this - but I'd be weirded out and bugged majorly if I were in your shoes.
Thank you for the warning, again!

It's micromanaging. It's really difficult.

I had someone resell an adopt without contacting me first even though my TOS says to. I hardly do adopts anymore for that reason. I don't like my designs trading so many hands they get confused, and I've seen it happen to others.

Correct me if I'm wrong but being that it is your art and that she did not pay you for the character anyways, isn't it still within your right as an artist to deny her the right to upload your art to her page?

I would honestly contact a mod, let them know you did not sell that character to them, they were banned from buying it, and they do not have your permission to have your art in their gallery.

Seriously I can't even believe they went and did that, that is just so horrendously disrespectful and unprofessional. I was already going to avoid this person, but now this just cemented they're someone I never want any where near any sort of adoptables I do.

They will definitely be going on a blacklist of people who may not adopt anything from me, or trade for any of my adopts.

Playing devil's advocate here, because I'm genuinely confused on this topic.

Ok, you refuse service to the customer (and rightfully so). That's all fine, and I would have done the same.

But then someone else buys the character FOR her, and gives it to her in exchange for some of her art.

How is this any different from being banned from a store (say, Barnes and Nobles), so you get your friend to go in to Barnes and Nobles and buy a book for you? That action is not illegal in any way, shape, or form, since you are legally allowed to own books.

I can see it being within the confines of copyright law that you don't want her to display your art on her page (and thus, you can demand her to remove your art from her FA page), but as for her getting use of the character from someone else - while it's disrespectful and definitely skeevy - she hasn't broken any copyright laws. The adoptable is a product that was offered for sale to the general public. Once the general public bought it, they can re-gift it, as long as re-gifting is not explicitly in your TOS, correct?

It would be like me buying a piece of art from an art gallery and giving it as a gift to my mom. Now, the gallery owner may hate my mom with a passion, but there isn't anything the owner can do to prevent me from giving said art as a gift (or trading it for something else, or re-selling it), once I've bought it.

Maybe in the future, add a clause to your adoptable TOS saying that the adoptable cannot be re-gifted, traded, or sold, and must remain within the property of the original buyer.

This is just sad. Some people want what they want, and tact, decency and respect for others will never cross their minds- because what they want is all that matters. I am truly sorry your character ended up in her hands. I had no idea who this person was until your previous AB post, and based on her begging behaviors alone I did not care for her (to say the least).. there are tons of people on FA who do nothing but beg tactlessly, but this 'beating the system' thing and going around you to get what she wanted because HEY SHE WANTED IT is a whole new kind of low.

(Side note: I'm not saying everyone who asks for help is just begging- I know there are plenty of people who fall on rough times and genuinely need assistance from those who can afford it and are willing to help. I'm speaking strictly about the people who put a post up like that every few days for various problems and yet continue to make luxury purchases while still asking for donations.)

I am not going to make assumptions, because I know there is no evidence on how this happened, but I just find it very odd that someone she doesn't watch, who doesn't watch her, just happened to offer it to her (as her submission implies). I really think she worded it that way purposely. It is my opinion that she watched the auction, knowing full well she would go to the winner to try to buy it. I am not saying this is fact, it is simply my speculation.. and something I would honestly not be surprised to see from someone who acts like this.

I'm sorry, this is just me rambling. But I'm really sorry this happened. :\

I recently made a comment on tooth's other beware. Seeing her "emergency" dog fund being 344/300. She is able to repay on money she owes or begged from. Guessing that money is what she was able to grab from others that are unaware of her behavior.

Everything seems really suspicious, her artwork is dead similar to Sin. on FA. The dot at the end of her name also, just very copycat.. Is Sin allowing her to use her style? I don't know. Is it only me that its bothersome kind of a red flag? She's making money off of someone else's drawing style.

Date: 2014-03-26 02:32 am (UTC)
From: [identity profile] whoop-zi.livejournal.com
I believe the account names are similar because it was once a character account and was given to her by Sin. A lot of people seem to be bothered by the similarities in style but tooth. claims it's because Sin. taught her how to draw.

I'm really sorry this happened to you. This is just a very low thing to do, disrespecting your wishes of her not having it in her possession.

I haven't done character auctions/trades for years but I'd always put a TOS saying that it's ok to trade it in the future but they'd have to contact me first to do so or I would assume the character was stolen. My characters are like my children so I liked to take that extra step.

It's a horrible curse with adoptables. You can sell them off to one person, but it's like once they're out of your hands, they're free to do what they want with them, and anyone who didn't get the character can either convince the buyer to get it, or just create a character of their own with a similar design but edited to their own liking.

The most you can do to prevent this, at least from what I've seen, is try to edit your T.o.S. to the best of your abilities. It's very hard for something like this to be prevented if the person(s) is/are desperate enough for the character.
