WHEN: October 9th and 22nd 2013.

PROOF: The original commission was supposed to be a stream one that she never
got around to doing. The entire conversation took place in LiveStream to set up
the commission. The only proof I have that I do have one from her is one of the

EXPLAIN: October 9th 2013 Nay held a commission stream. I commissioned her then
for a two character piece of my fiancee and I in a two character mature pinup.
I paid the first $140 to have it done and waited my turn in the stream. Nay got
tired and ended the stream, saying she would finish the que at a later time.
Later in October she put up a journal that she was going to try her hand at full
blown Porn/Adult art. I paid her an extra fee to make my commission Adult (See
payment proof). Months and months go by and I do not hear a thing. I contacted
her again to see where I stood in her que. (See proof one) she told me I was
being worked in. Continued waiting. I contacted her again in September and she
read my note but ignored it, not bothering to reply this time. I sent her a
third note (see proof five) but she is now ignoring me entirely. Nay is
actively taking new commissions all the time via stream and on FA, but ignores
her existing customers. I have dealt with 240+ artists in my time of
commissioning art and this is the first time this has happened to me.

*Edit: Established contact with artist. Work resumed on piece and commission was completed.

Disappointing to hear that. I really love her art, but I don't think I could commission her if she's ignoring you.

It's always very frustrating when an artist refuses to make contact with a client. As much as I don't like the idea of using this website to force any hands, I do hope it brings this artist to at least make contact and try to settle the transaction.

I also wanted to comment on the OP themselves! Having done several commissions for this client in the past I have nothing but great things to say. They are always very kind and a pleasure to work with! I highly reccomend working with them! Because of my personal experience with them it baffles me how the artist in question could outright ignore them given how kind and understanding they are.

I feel that it should be pointed out that there are a couple lines on her TOS (http://nayelie.wordpress.com/2013/01/01/terms-of-agreement-2013/) that might explain why she's ignoring you: One line says she'll ignore notes asking for ETAs, and another says that clients are not to ask how long their art will take. She's also got a (scary) blanket "no refunds" policy.

There might be some hope, though: She has a journal posted with info on how clients can remind her of an owed commission (http://www.furaffinity.net/journal/5736298/). I know she deletes a lot of her journals, so maybe the fact that this journal hasn't been deleted means it's still an "approved" method of contacting her? Some of her comments make it seem like her ability to keep her backlog organized is a bit weak. Hopefully, it's as simple as your commission slipping her mind, and re-sending your info through e-mail will get her back on track.

Oh, I agree. Her TOS certainly does not excuse her failure to communicate and deliver the owed artwork in a timely fashion. I was just including it because it might help explain the mindset behind her choice to ignore you. I always felt like her TOS sounded almost hostile, as if the commissioner were an enemy. :(

Holy crap. Reading that TOS is like reading an angry letter from your mom or something. It's so condescending and aggressive. When you said it was hostile, you weren't kidding.

Honestly, I don't think I would ever commission an artist that refuses to correct mistakes, refuses refunds, and outright treats potential clients like pests. I don't watch this artist so I don't know their behavior otherwise, but from that TOS I don't think I would ever want to do business with them.

Why wouldn't she?! This is madness! MADNESS!

That said, even if she only has the flattened PNG, yes you can fix mistakes. That's what Photoshop does, enables you to make dramatic changes to flat files! Even SAI offers decent options to edit flat work. But what on earth would posses a digital artist to only keep a flattened file of lesser quality?!

It's like making a painting, taking a photo of the painting and then burning the painting. There's just no reason!

WHAT?! It's basically a part time job making sure you send all the right information and keep resending it every so often for months on end, or she might forget to do your commission that you paid for in advance.

Let me guess; she cancels the commission and you don't get a refund. She will never post an "abusive" customer here because this community would rip her a new one for having one of the worst TOS' ever seen in this fandom.

I don't have a screenshot (so take this with a grain of salt), but I seem to recall several months ago that she made a journal stating that she was giving out partial refunds for commissions she had recently taken around that time. Apparently these were not started either. When several people called her out on this, she promptly deleted the journal.

And yeah, like thaily said, you're not the only person waiting unfortunately. :/

The artist initiated a trade with me in July and for some reason was very insistent I finish my half first. I can sell off the items I made so not too much of a problem, otherwise I would have said no as been stuffed with trades far too many times to count.

I think it was a bit unwise and unfair for her to ask for trades when she is this back logged with commissions. I've only been waiting a couple of months so haven't been too concerned, though I was expecting the trade to not take more than a month or two. At least in my case it's not much of an issue.

It was more an ironic statement than anything, really.

She'd be essentially getting paid X amount of times for uploading a single image or however she works it, which means she'd have more money for 'bills', thus her "no refunds because I have bills" excuse is null and void. Not that it held water in the first place.

Maybe file a bank chargeback?

They chargeback paypal and then paypal will take the money from the artist. It's how you can get around the limit for paypal. You don't contact paypal, you contact your bank.

I'm really glad to see her on here; I knew it was only a matter of time. I've had my share of troubles with her in the past and I got really close to making a post on here, but I didn't want to deal with the backlash.

She's long deleted the journal, but a few months ago she made a journal asking for everyone who she owed art to post in it. The journal disappeared after it went up to ~4k$ of owed art and people were starting to ask questions. I've dealt with 100+ artists on FA over the years and this is the first one I've unwatched/blacklisted over a commission.

I would also like to point out; don't bother with in-stream commissions. One would think that these would be done instantly, but she usually ends up taking more than she can handle and adds the one she couldn't finish to her already insane backlog! (Exactly what happened to the one posting the beware; she's been doing this for at least two years, as far as I know...)

Either way; this beware is well warranted, and my advice as another one of her ex-customers is definitely to skip her!

I know this is an older beware but I wanted to update on the unfulfilled trade I mentioned here. It's been a year now and she still has not done her half.
Sadly I don't have the original notes to create an actual beware post on it. She did contact me about it earlier this year about it and wanted me to do more to make up for her put her prices up in the time I've been waiting!
So yeah, if she contacts you for a trade and wants you to do your half first then please don't agree to it as you're unlikely to ever get her half.
