Needing advice about a commission.

Last year I commissioned a DA friend of mine in November 2009 for a 2 character fully (traditionally) colored commissions and a colored ink commission which came to around $33. I sent her the money, and she told me she has gotten it. On February 11, 2010,  she uploaded a inking of the first commission, and I approved of the inking so she could start coloring it. On March 24, 2010, she uploaded the fully colored version of drawing (which was switched to digital coloring), which she now made as a gift to me instead of being 1 of the 2 commissions I paid for.  We spoke in notes and she told me about how she was sketching the commissions and how she liked them thus far.  Two months after the image was uploaded the artists ended up leaving deviantART because apparently she accused another artists on there from stealing from her and according to others she was doing the same thing she accused the other artists of doing (stealing art), so she deleted everything off her dA account to move strictly to FA.  Around this time I spoke to her on FA via comments, and she told me she was sorry about me still waiting on my commissions (this was about 2 months ago). I never heard from her after that, until about month later when  she posted another  journal but this one was about how her life was crumbling beneath her, and now she no longer has time to do art nor was it a main priority to her anymore... In that same journal she also wrote that she probably wasn't going to be around anymore.  This is really upsetting to me because I have noticed her checking her "supposedly" dead DA account, and adding people to her watch list on that account. Overall her actions have really not only upset me, but have hurt me as well because she was "suppose" to be a friend (internet or not), and I paid her for artwork that I haven't seen or even gotten.

I understand life gets tough, and sometimes you end up losing the internet and are unable to contact your commissioners, but she has been online since she told everybody she wasn't, and I have sent her notes since then that have gone unread. I would just like to know if she ever plains to do my commission or not, and if she doesn't then I would like a refund.

I just don't know what to do at this point anymore. Should I continue to note her? Or should I wait a little longer to see what happens? Its been over 8 months so the only record I have of her getting the payment is a confirmation from her stating she got it (which I do have screen capped, along with all our  comments and journals).


On another note,  I am sorry for keeping the name hidden, but if the problem keeps going unresolved I will re-post with screen shots and with a user name.

First of all; even when I wasn't uploading or active on my DA acct, I still used it to watch artists I liked. Nothing weird about that.

Second; Did you ask for a refund? In any of the notes that you sent to her? Did you comment on the journal asking about the status of the commission?

Also, how long has it been since you sent the notes? A week? Two? A month?

I only said it was a bit odd how she still gets on DA even though she told everyone she would probably not be online anymore, and everyone else thinks it's a bit odd she has been getting online, but not talking to people she owes commissions too (I am not the only one who has noted her). I have asked her for a refund in another note I sent on FA, which went unread but I am not sure if it maybe got deleted accidentally (I have done this once or twice by accident) or just being avoided, so I sent her another one about a week ago saying:

"I understand you left DA/FA and that you are going through a rough time, but I paid you for a commission and was wondering if you were going to do it or if you just were canceling it. If you aren't going to do it please send my money back, thanks."

I sent this both on FA and DA, which they both have went unread too. I don't want to sound rude or make her upset with me, but I just want to know what's going on since she has been on DA. I just want to get some advice on how long I should wait again before noting, and what I should say because I don't want to sound like a complete cunt.

But uh, basically i'd give it a month of no answer, from the first note you sent, to put out a warning about that person. A month would give them plenty of time to check at a friends house or something if they dont have net so...

Reading this was a quite difficult for me since it was a huge block of text.

May I ask how you paid for the commission? If it's paypal, you should still have the email PayPal sent you telling you your payment has been sent. If you delete those emails, that...was utterly foolish, and I would suggest from now on to always save those emails. If you've never gotten one from paypal, maybe you should check your junk/spam folder for it?

Even if you get a refund, I feel that it should maybe be a partial one, since she already inked part of the first one. Even if she changed her mind and made it a "gift", she still did work that you approved of as a commission. If that makes any sense. Especially IF she has mailed you the inks already. (Did she??)

But I agree with the above. Give it a month, then I'd like to know who the person is as well. :(

I have never gotten anything in the mail, and the only reason it became a gift was because she got the markings incorrect when she inked them and showed me, and she also did it digitally when I strictly paid extra for traditional media (the commissions I paid for where two fully colored w/background tradtional media. I paid extra for the characters and they were most costly than the digital).

I will give it another month then update with all the info I have.

Umm no. She noted me about a few days after the sketch/inking was uploaded and told me she messed up on the markings and felt bad about it so she made the one drawing a gift instead. I never knew she messed them up.

Um, for one it was a commission not gift, and secondly the markings have nothing to do with what was posted. A person asked a question about why she made it a gift instead, so I answered. The end.
