I'm not going to post any names as to WHO I commissioned from to save them the drama, but I've been having issues with this particular fursuit maker and I've kept hearing excuses as to why my suit couldn't be finished and after speaking to several customers and people that know this person, i've heard nothing but bad news. I canceled my commission from this fursuit maker and said I would like the refund by the end of july if possible or end of august. I was wondering by anyone elses experience as to what you do if you don't get your refund from this person? Do I take it to court...I know that sounds silly but it's alot of money to just forget about. I do have documentation of the payments as I did it over paypal. So, in any case I don't get my refund what should I do? Thanks!

Small claims court might be the way to go if the person doesn't refund. Another is of course, tell them you will reveal their name here. :P

Date: 2010-07-31 10:27 pm (UTC)For me, whenever I need to give refunds for mascots, I offer to do it in monthly payment plans (usually in $50-100 increments), depending on the total cost of the costume. I try my best to give refunds as soon as I can, but without a job (only income from mascot commissions), refunds may be slow but I try my best to keep paying. This /may/ be the case with your commissioner, but I don't fully know your situation.
So try the payment plan thing IF the person doesn't have a steady income (however, if they do or appear to have one, ask them to refund you in full immediately). Get a response as soon as possible and specifically state that if they don't reply to you within a certain amount of time, whether or not they can pay now, you can post them here or take it legally.

Does bad news mean they've been in poor health, financial trouble, or real life drama, or does just mean that they keep giving you excuses?

Date: 2010-07-31 10:46 pm (UTC)as for the bad news, I've been hearing from other customers that they keep hearing the same excuses, examples: the dogs ripped up the suit when I hung it out to dry, I don't have a car so I can't buy supplies, my car got repoed, my email was down, etc. i've also heard from another source that used to be friends with this fursuit maker that this person blows the money as soon as they get it for either buying fur for personal suits to sell, on junk food, own personal things, etc. and that this person also hangs out with friends all the time and is just plain lazy in general. i don't know if it's true or not but hearing it isn't reassuring to me in the least. oh like your icon btw ^_^

Date: 2010-08-01 04:25 am (UTC)It sounds like they're stalling and you might be taken for a ride. I agree with the people that suggested a repayment plan so maybe the person will be more willing to refund you. It seems when people get myriads of weird excuses that it never ends well.
I think if you last paid in May you might want to check on it since Paypal has a time limit for disputes and you might be close to running out on a chance to dispute the last payment you made if you don't hear back from them on a refund.
If you feel you have to get legal action, it'll probably be small claims courts and will probably come down to state laws provided the fursuit maker lives in the US.

Date: 2010-08-01 04:23 pm (UTC)Hopefully your situation isn't as tangled as that, but it cannot hurt to contact the local Department of Commerce [ if in the US, the artist's local county or state] and to also send the artist a certified letter stating what you're doing. It's great that you have the PayPal documentation as well, as that's a good weapon in your favor. If the artist is stubborn or won't respond to you, it can get a little tiring. Don't give up, though.
