I commissioned a Fursuit from him over a year ago.

After several months of no progress and his sudden gain in 20 commissions of himself, I messaged him asking about it's progress.
I got the reply "I'm not working on it because of your attitude, you don't deserve it."
Demanding a refund he replied "I'm not refunding you either, deal with it."

He still refuses to refund me, and has blocked all communications with me on FA.

(I'm not sure I did this right, my first time warning people.)

His Response:

Materials that were shown were leftovers from a previous suit project, he has deleted the photo.
(abuse stated being that I had long before this event on my msn status stated I didn't care for "cuntboys" all that much and he took it out of proportion during the dispute)

Paypal receipt (my last name and prices blacked out at request of my husband)

I'm deathly curious, do you think you could provide a screencap of that reply? I mean... seriously? That's pretty tacky, if not all out illegal. If I could deny service based on attitude at my job I'd never be paid (commission-based)!

Edit: And I'm assuming Shadow-woofie is the party in question's FA name?

That is downright just... ugh! I also concur that you should show some screencaps, and if everything proves to be true you should threaten legal action. Unfortunately you can't do a paypal dispute since it's been so long, but perhaps you can find out their personal info somehow? Or you may still have the person's paypal info if that's how you paid?

Yikes!
Yes, not saying I don't believe you but proof is always welcome (how did you pay / receipts with personal info blacked out / screencaps of emails)

Yeah i agree with the above i want to see a screencap as well.

Wow. Yeah I'm definitely curious to see what the correspondence between you two was.

Whether or not he likes your attitude, he still needs to either give you the suit or send you a refund. What a douche canoe.

Was gonna say - didn't we have a case pretty much identical to this one but for a plushie instead of a suit not so long ago, and Dragoneer did indeed get involved?

I believe that girl got her refund, too.

That is so not cool. I'm sorry for your ordeal, hope it wasn't too much money. >_<

More details would be nice... the exact date you paid, the correspondence you two had, and a link to who this person is, because I've never heard of them.

As others have said, evidence would be nice, also I suggest complaining to FA with evidence of your claims, since they have suspended people in the past for not delivering the goods or the refund.

After reading the messages and seeing the receipt, things do not appear to be as clear as you have claimed it to be in your post. According to your receipt it hasn't been a year yet, granted it's only 2 months shy, but even so. And have they given you any progress images in this time?

There is the other huge matter regarding those two emails. It appears that you have talked with this person extensively before, and previous interactions have not been good. More importantly, why did you block them? Doing so seems highly counter productive and causes problems like the one I'm seeing here. It's not good that they've left you hanging, but from what I can see so far and even in your own email, your conduct in the matter has appeared to be just as childish.

I have talked to Shadow-Woofie.

The big issue here is that all the materials (what was paid for, and 30% of the suit costs) were all non-refundable things when Xitokii canceled the suit. Shadow-Woofie claims Xitokii stared to have issues almost over night, it devolved, and the suit without warning.

So Shadow-Woofie's issue here is that now they're stuck with quite a bit of expensive material's they can't readily use, can't get refunds for, and is stuck with the brunt of that cost.

Shadow-Woofie said her refunding the deposit for non-refundable materials severely burns her for Xitokii's actions, both of them had issues with each other, and Xitokii didn't try to be civil or work it out with them. It was known these were non-refundable supplies for the suit as well.

I can't speak for either party, but I have had dealings with Shadow-Woofie before, and they've been polite and on the level.

From dragoneer's comment, and one of the emails it looks like the artist is only holding the 30% non-refundable deposit for materials. Is that correct? If that's the case, I think the thing to do is discuss shipping for the materials.

From: [identity profile] ryunwoofie.livejournal.com
If you Paid only the 30% I see no fault of the maker here, regardless of what you two have discussed it's non-refundable.. If you happened to pay MORE than the 30% then your entitled to that, but if not.. your SOL.

If you have a problem w/ them your out of luck getting any of the 30% back, but if you continue.. I wish you luck.. Sorry it happened, and hope it gets resolved..

even if %30 is non-refundable, shouldn't she get /something/ back? I mean, if it was used for materials, then shouldn't the materials get sent to the customer, or something like that? I mean, I know the money went to something reasonable, and it's understandable that money can't be sent back once it's spent, but I don't really see where it's ok that she get /nothing/.

I can't help but get the feeling that there is more to this situation than you have provided. More screencaps and proof of this abuse would be good. Not that I don't beleive you or anything, but it will strenghten your claim if you show evidence of ALL dealings.

Date: 2010-08-08 06:49 am (UTC)
From: [identity profile] ninykinin.livejournal.com
also, I couldn't help but notice he doesn't appear to be refusing the refund, he just claims that you cannot get a FULL refund, since he has already spent the money on the materials... which seems fair enough to me, and he probably covers that in his TOS, if you read it.
"as I do with all customers, 30% of the total suit price is NON refundable once I have brought materials for the suit"

"I got the reply "I'm not working on it because of your attitude, you don't deserve it." Demanding a refund he replied "I'm not refunding you either, deal with it.""- Please provide evidence of this conversation.

This could just be a misunderstanding.

I do not like that the cost of the suit, the cost of materials and the amount paid was not shown.
All we got was both parties being snippy in an email.
