Edit:  I sent mechasheep a note telling her that if I wasn't shown proof that my suit was being done Id file a chargeback claim with my bank. She responded to my ignored note from last night and said that she would accept a deadline and possibly even have it done a week before then. So I told her that i wanted it a month from today (its very possible to have a suit done in a month or less, Shadowsani had mine done in about 3 weeks with amazing quality) and that I wanted frequent photographic updates. She read it but didnt respond to this last note.

This note in question was the one I sent last night asking if I could request a deadline (which was initially ignored) she responded today after I told her Id be taking legal action if something wasnt done.

Hello,
I was hoping i wouldnt have to post to this but i really need some advice on what to do. In october i commissioned mechasheep for a fullsuit at the price of $600. She seemed eager to keep me updated and said that i needed to send in a DTD and shed start right away. I sent it off with delivery confirmation, but since shes located in canada it didnt update anymore once out of the country. I contacted her in late november asking if she had received it and she never replied, in fact all my attempts to ask her polite questions were repeatedly ignored (they still are) and she is active on FA, because she faves stuff every day and my notes show that they are read.

I got in contact with another person who commissioned a suit from her and they asked for WIP pictures, on it which they never received, on their suit which was allegidly pretty much done. they obviously are kinda at loss because she keeps ignoring them too.

I also noticed that other people who commissioned her for art quite some time ago are also waiting for replies that never come, if you look at her journals and whatnot.

So what should i do? Should i open a paypal dispute or is it too late? Or is there another means to go about this?

Thank you for your help,
Neonr0se

You can only open a Paypal dispute within 45 days of the initial payment.

It's too late for paypal dispute, but if you used a card to pay through paypal you still might be able to contact them and file a chargeback. (if you paid through a bank you could try contacting them too)
And yes if she is ignoring you for over a month with no sign work was even started I think you should do this. Send her a note and let her know while you are making inquiries on the process.

Oh! I bank through Wells Fargo. Yes, call them immediately, and explain to them the situation. Wells Fargo is pretty good about helping you out.

Go to your bank or credit card, tell them you paid for something you never received and issue a chargeback. PayPal will investigate it, put the funds on hold, and if she can't prove that she shipped it, they will most likely refund your money.

Wells Fargo will pretty much make them. They've done it for me before.

This; they're a pretty good bank. =) (I don't use them myself, but my parents do!)

Yep, they have to. If the bank is saying they want the money back, PayPal will have to investigate if the bank has a valid claim for a chargeback or not. I just had someone's bank auto-issue a chargeback on me for what they thought was an unauthorized charge. The customer didn't even ask for the chargeback, but since the bank automatically requested one, PayPal had to investigate. All I had to do was provide a tracking number and the claim was dropped.

If she can't provide a tracking number, however, she's probably pretty well screwed and they will yank the funds out of her account.

I'm glad we got it resolved too! :)

If she doesn't have the funds in her account, I think they can actually put her account into the negative and then she'll have to pay them back pretty much. Basically anything that goes into her account will become PayPal's until that $600 is paid back to PayPal. I think. I am pretty sure you will get your funds back within a couple days of them deciding in your favor. Banks and money lenders have insurance for these kinds of situations.

Yes. Her account will go into the negative. Paypal will allow her to pay it back.

Honestly, if you are going to do this, I would send her one final notice. She needs to show you some kind of proof that she has made this item and is preparing to ship it, otherwise this is what you are going to do.

That's odd, I had this happen to me too and despite me providing evidence that they had been refunded via the refund button through paypal they gave her money back--she got a 24 dollar refund on a 12 dollar payment >_< They told me there was nothing they could do =/ maybe it depends on the credit card? I know there's different terms.

Wow. That's really scummy. You should consider posting about that, as they essentially stole 12 dollars from you. Assuming this was art related that is.

It was on etsy, but it wasn't a custom piece so I don't think AB would be the best place to report it. The initial error was my fault (I sent them the wrong item) but I IMMEDIATELY refunded when I realized the mistake, talked to them and they decided they'd rather have the refund than a replacement. I didn't get the chargeback until a few months later, it was the strangest thing =/ The customer kept saying they didn't know what I was talking about (I think they were lying though...) I tried contacting paypal via phone but they kept telling me it was out of their control and to me it wasn't worth the 12 dollars to pursue it.

That is really weird. I would have called their customer service and raised hell.

I tried but after the third representative saying the same thing I gave up...it was only 12 dollars and not worth the high blood-pressure. If it had been more I would have really pressed it because it's theft plain and simple--I still don't understand why the refund counted for nothing.

I think what happened is that the refund was paypal money and not returned credit--when the creditcard was recharged the money had to come from somewhere (the card company probably didn't recognize the refund for what it was) and rather then waste the time fighting on my behalf paypal gave them my money so that they wouldn't have to pay it themselves.

Quick edit for clarity

The bank will do that. Paypal once withdrew $50 twice for a single transaction. I contacted the bank then Paypal. My bank returned the $50 to my bank account within 24 hours. Paypal returned $50 to my bank account the end of the week. O_o Paypal eventually caught their mistake and deducted $50 from my PP account.

That's sad to hear. I currently have a deal with her too. (As it stands I probably wont go through with it either..) It seems hard to get in contact with her, it took me several times to just find out if she got my DTH too.. I've also only payed her $30 for some eye materials.. All I can say is just keep harassing her via note, shout, and her journals.

Seems she owes people art too and is only doing things she wants to. I guess one should expect that from someone so young. :\

I hope it gets resolved.

If she could get her act together I may go through with our deal, but at this point Im just sitting back and watching..waiting. I can wait forever too as long as they let me know what's going on. :C We'll just have to see..

How old is she, if you don't mind my asking? I know it's not common, but there are a few people who are able to do business responsibly when under the age of 18 and there are the occasional adults who can't do business better than a child.

Maybe legal action will be the right kick in the butt to teach her to grow up and do business like adults.

She is in fact 18. So says her FA account, who really knows lol.
I don't have enough invested to go to that level, but Neonr0se does.. >.>

Well I wish you luck w/ whatever happens, I hope you update us too with her reaction and results. I would like to see how she handles this.

Ah, yes, I was referring to neonr0se pursuing legal action, I apologize for not clarifying.

A year really shouldn't make that much of a difference in behavior, you know? Just reading your post and responses, you seem like a very even-headed, mature individual in an unfortunate situation. I hope it works out for you without having to take it to court!

I hope she can deliver, it would give me more hope in our deal. But it's sad that you'd have to come to this to get a response at all. :C

I really hope you can get this solved and fixed as soon as possible, that's just not right. I'm on the same boat right now as well with a drawn commission.

This may be a bit late. But last October I commissioned her a Digital fullbody when she was offering them really cheap. I paid up front and still waiting for my picture, I've sent notes/comments that have also been ignored, I noticed a few people have the same problem. I want to ask for a refund but afraid I may never get the money back from her, since I know some people have been waiting a long time to get money returned to them.

If there's any advise anyone can give, that would be great.
Thanks
