What: Commissioned Miss Paint to do a non adult piece of my character and my friends.


When & Explanation: Commission was excepted by the artist on Nov 20th, 2011 she noted me the price would be 68.00 in all and to expect work to be finished by mid December to early January. I then sent the artist the amount requested by PayPal that day. After December and January passed I waited two more months and the first note on April 6, 2011 asking for an update, no reply was received, I again sent a note on April 16 and still no reply. On April 30th the artist made a journal saying she was going to start refunding all commissions, on May 6th artist uses excuse of surcharges from 3 citations has pushed back refunds. On Jun 29th I gave the artist a deadline to refund the commission and the next day she finally responds saying she would refund then proceeds to lecture me.

Digital art transactions are technically against their TOS

I've never heard of this and always assumed it counted under Service. That sounds incredibly odd to me.

Though even if it's true, she had no right lecturing you, especially when she offered the refunds.

Selling adult work without a physical item being mail is against the rules, however digital artwork of a general nature is not.

It's really awkwardly explaining in the ToS, it's really just to keep people from using Paypal is sell say, Adult pay site accounts.

Actually, IIRC form the whole paypal issue before, it's selling actual physical porn (DVDs, books, etc.) and not art services, that is the problem.

It's not against their TOS but you can't issue a dispute over it because it's an "intangible item". Kinda weird.

I can't really blame anyone though, but back on topic, I wouldn't have commissioned her in the first place if it was apparent she got a lot of traffic tickets and the sort..

I'm another reptile lover and had several smooth commissions from Paint, so I'm sorry to see it come to this. I did see her journals about the fines/refunds and her tone in those alone was making me raise a brow. She was rather preemptively defensive against the very people who were supporting her, focusing on lecturing them on what not to say to her rather than apologizing for not getting the work done/having to delay refunds.

On the plus side, at least this time she refunded you quickly so I guess that's something.

Wow man, what a surprise to see someone like Paint here. :C I actually rather like them and their art, so it's a shame to see them listed here.

Goodness though, that final response. I watch Paint and keep up with a lot of their journals so I know it must be stressful having to deal with all the tickets and things they do, but I don't think that justifies that attitude. At the very least, I'm glad you got your refund.

A friend of Paint's offered to draw sketches for those waiting for refunds in an effort to keep them happy and she replies:

"loooooots of refunds. However I'm trying to keep them up to date and I'm building and sharing a refund schedule. That's all I can really do. Doing that shouldn't be necessary - some people have gotten needlessly rude and a bit too aggressively impatient, but they also tend to over step their boundaries and make unreasonable demands, the last thing they need is a reward for that behavior haha."

Um. Wow. Sure is unreasonable to want to see some progress (or have their notes replied to!) after several months. I know she works fulltime but other artists manage to get a little commission work done here and there on similar schedules. I don't understand why she doesn't just do the work.
