Side-note: I did not ask the deviants of Complaints forum to harass or point out Bunny's errors to her. I honestly did not expect them to pounce on her the way they have. Nonetheless, she continues to hide the comments, even marking them as spam, pretending as if nothing's happened.

Date: 2012-10-01 10:17 pm (UTC)The reasoning that they can hold onto the money that was paid to them for goods which were not delivered if they find that their client is "trouble" shows an emotional response to something that they perceive rather than good business practice.
After the monetary breakdown of where the money went, I think the solution would have been to send the OP the wigs and both parties have done with it. If Rabbit Tales has bought the wigs then the wigs belong to the OP.
I am going to ignore the side projects on this. I have build a plush or a puppet in the middle of working on a commissioned piece to clear my head. However I keep a careful eye on my deadline(s) and make sure my clients know where things stand. WIP are important here.
Now the $110 question is, did she send you the things that she said she was going to send you?

Date: 2012-10-02 01:57 am (UTC)What this artist is doing is theft, plain and simple. You cannot just take someone's money and then never deliver their product, even if they were really nasty to you. OP was very nice and patient, and the artist was way out of line.
I think the only mistake OP made was not establishing a deadline. Even if it is 6 months to a year out, always make your deadline known.

I cant explain today >_<. And update now and then is nice and her TOS is just cruel and scares me. Her behavior, she either have/had a bad day or she need to maybe to learn of to treat customers and so on.
Hope she wont hold back your wigs.
So I guess next time, make a deadline or ask for how long it takes for finished product.

Date: 2012-10-02 02:07 pm (UTC)Its okay! And yeah, I always update my customers on how their commissions are going like, when I'm sketching, inking, colouring, etc. I never like the thought of leaving them in the dark!!
She's reacted the same way with others, she always seems very unapproachable and quick to defend herself. Like she made a Luna wig and the commissioner wanted it purple, instead of blue. When people prefered Luna's wig to be blue, she hissed at them that the commissioner wanted it purple. She even went as far as saying if anyone pointed out the colour difference or that they simply prefer blue Luna over purple Luna, she'll mark their comments as spam o_o'' its a bit harsh!! People are allowed to have opinions, but it seems anything that doesn't directly ass-kiss her oh-so-amazing work, she removes.
It reminds me of how I started out in drawing. I used to be very sensitive towards constructive critcism but I now know it's something I have to learn to deal with - positively! The fact she hasn't grasped that concept yet, I fear her business and her artistic ability will suffer badly.

Date: 2012-10-02 03:59 pm (UTC)I'm really sorry this happened to you, you seem like you'd be a pretty patient and understanding customer. It's s shame she thinks she can take people's money and not deliver anything to them. Theft is theft, and for some reason she seems to be okay with it.
Hope you eventually get some kind of compensation for the money you paid. Her work is lovely, but her ideas of how to run a business are downright awful.

I would love to get compensation but just receiving the wigs would be enough - I may not be able to achieve the commission design exactly but I should be able to use them for something else if possible ^-^;;
I would go the legal route but unfortunately, its not very cost-effective to do so. It's a pity because a lawsuit would be just the kind of wake-up call she'd need!

Yeah if it wasn't ever agreed to, then it is not contractually binding whatsoever. Most people have a clause that you're agreeing to their ToS by default by commissioning them, but the ethics on this are debatable.
Also, clauses do not apply retroactively so if someone accepts a commission and changes their ToS later, the changes do not apply to clients who agreed to the older version.
