EXPLAIN:

I held a YCH mature auction and KitNabarii bid on both of the poses. She won the picture for $50 total and I gave her the quote and told her to send the refs to me. I received the refs but not the payment. I contacted her again a week after asking for the payment but never received a response from her. Send another reminder on the payment another week later but didn't get any kind of respose for that either. On the third try (almost month later) I got a respose that she will be paying later that week, but of course I never got the payment.

Because I had not heard from her on Friday or weekend for that matter, I sent her another note asking for the payment and she told me that she was at hospital (I think?). I received a response that she would pay me on April 12th and I told her that I would be waiting for till then. I was really frustrated but being way too nice about this and decided to wait. Friends told me that it has taken way too long for her payment but I was still being too nice about it because I really needed that money.

After sending yet another message on the payment after the 12th, I got a message from her saying that her Paypal was closed down till May 1st (she said that she told me but I went trought every message and she never told me that). I said that I would wait till then but of course I got nothing after 1st and sent her one last reminder message on 3rd. I will not wait anymore because I know I wont get the payment (unless she pays after this post has been published).

I know I was being too nice and gave her over 2 months to pay because of her 'issues'. She never told me anything beforehand, only after I had sent her note. The last note is still unread and both of her accounts have been inactive for couple weeks. I learned that I will not let myself give the commissioner that much time to pay when the payment was supposed to be sent in three days.

I'd seen her flitting all over FA with no drama, so I figured no news was good news.

Unfortunately not :C Sorry you had to deal with this OP. Good luck if you decide to relist it.

Yeah this has happened to me only they are non bid YCH's I just Ignore and have her already blacklisted.

Your not alone and I'm sorry this happened to you..

Tip that might help!

If you hold auctions like this make sure there is pay date. If they don't pay by that time then reopen the auction. If they want the spot they will rebid.

Date: 2013-05-15 09:56 pm (UTC)
From: [identity profile] nxcritter.livejournal.com
As well if a bidder does this twice in a row, and it's been over two weeks I would hide their comment or bid. due to having to repost twice on their behalf.

People who work normal jobs normally get paid every two weeks so this way they have a chance to get paid again if needed.

I hope this helps!

I'd like to point out you said you wouldn't post her to A_B and well... that was either a lie or you went back on what you said, because here we are
In the future it's just better to say "I will post you to A_B if x deadline is not met" or just not mention A_B to them at all. Saying you won't and then doing it anyway- even if she's a bad client- is dishonest.
Otherwise you handled this pretty much as best as you could

From: [identity profile] kasune.livejournal.com
Seriously, this. What's with this kind of thing popping up in the last few bewares? It's unnecessary. I agree that the beware is warranted, but don't make yourself look bad in the process if you're the OP of a beware.

Date: 2013-05-15 11:08 pm (UTC)
From: [identity profile] neolucky.livejournal.com
I wish people would either stick to their guns and post when they say they're gonna post, or don't post if they are promising not to. It just gives me a bad taste in the mouth.

I wager that using AB as a bargaining chip can be useful so long as it's done with tact and honesty. Why in the world people would use it as leverage like that is beyond me. It feels like blackmail just a tad bit.

Date: 2013-05-15 11:18 pm (UTC)
From: [identity profile] spiffystuff.livejournal.com
Yeah, if someone's going to post anyway they should say that "at this point I'm making an AB post, but if you fix things by ___ date I'll be sure to include that and it will be marked as resolved"

Date: 2013-05-15 11:24 pm (UTC)
From: [identity profile] kasune.livejournal.com
Exactly, in the last few posts I have seen (not this one in particular, though) it does seem like the option of A_B has been used as a form of blackmail. "Do this or I'll post you on A_B if you don't." It just comes off as really rude and tactless.

I can understand going "Here's a deadline, I expect you to meet it" politely, and when it fails, "The deadline has passed, I'm afraid I'll have to post you to artists_beware for not cooperating." There's a lot more tact in that because the chance was GIVEN already.

I just think leaving it out altogether is better from a business perspective. I wouldn't want to start any potential drama by mentioning this community, even though it's NOT a drama comm.

Date: 2013-05-15 11:29 pm (UTC)
From: [identity profile] neolucky.livejournal.com
I agree entirely! I just personally don't even mention it for any reason. If after the transactions been done and I feel it merits some sort of beware, then I'd do it. But for the most part I do everything I can to avoid having to use it. It just shouldn't be the first verbal-weapon people use in negotiation.

Date: 2013-05-15 10:15 pm (UTC)
From: [identity profile] duster.livejournal.com
Yyyeah, she tends to buy buy buy then come up with a million and one excuses as to why she can't pay. She's been doing it for a while and it doesn't make a whole lot of sense.

Check her tag for her laundry list of completely outlandish excuses, it's pretty ridiculous.

Date: 2013-05-15 10:40 pm (UTC)
From: [identity profile] kasune.livejournal.com
Really sorry to hear that you got burned. This isn't new for this commissioner and it should be made clear that NO ONE is to accept commissions from her.

You did great in handling the transaction, so props to you. I was surprised at how calm your tone read in each of those notes, but in a good way- most artists that are stiffed on payment grow more and more impatient and it shows. The only thing that rubbed me the wrong way was mentioning A_B at all- whether you're doing it or not, it's just not a good idea to bring it up, IMO.

Beware well warranted.

From: [identity profile] mekania.livejournal.com
I don't understand this attitude, I've seen a lot of advice posts telling people to mention posting the situation here in order to get a response. It's only these last two posts where I see people arguing against that.

Generally I agree that it's better not to say you won't post and then do it later but this is both a review site and a tool so I don't blame people for using it when they're out of their money/time.

The artist whose behavior warranted a bad review enough that the customer had to threaten exposure to get results is, to me, someone who needs to be posted more than pretty much everyone else. If a customer lying to get what they paid for/their money back is a personal concern for artists, then maybe they shouldn't put the customer in the position to need to do so.

Date: 2013-05-15 11:33 pm (UTC)
From: [identity profile] kasune.livejournal.com
In the end it lies on wording, I suppose. The last couple of posts have come off as a form of blackmail, as Neolucky has said above. It's more of a "do this or I'll ruin your reputation" sort of thing. That's just my personal opinion though, and can see your point of view as well.

I did say this above:
I can understand going "Here's a deadline, I expect you to meet it" politely, and when it fails, "The deadline has passed, I'm afraid I'll have to post you to artists_beware for not cooperating." There's a lot more tact in that because the chance was given already.

That would be my way of provoking a response, as you said.

Spiffystuff also made a really good point that I missed, but now agree with- a beware can still be resolved, so there's that. :)

Date: 2013-05-15 11:53 pm (UTC)
From: [identity profile] mekania.livejournal.com
Yeah, I agree that wording it right would be preferred but I don't hold it against people who don't. It's definitely not blackmail/extortion when you are actually, legally owed something.

People at my old small business job used to threaten the BBB and yelp reviews all the time and a lot of times even with the situation resolved they would still post bad reviews. It's not a big deal and is typical/expected behavior when you're a business, small or otherwise.

Date: 2013-05-16 12:17 am (UTC)
From: [identity profile] timelapsedecay.livejournal.com
Even if things are resolved, it's not unfair to make a bad review. People do it here all the time. What's in question is saying you'll do one thing (or won't do it) and going against that. At the root, it's plain dishonest. Dishonesty's not professional.

Date: 2013-05-16 01:47 am (UTC)
From: [identity profile] mekania.livejournal.com
I was not speaking about just plain old posting bad reviews. I was saying customers would do the same thing at my job, threaten to post bad reviews if things don't get resolved and still post those reviews regardless of the resolution. And like I said, it's a part of doing business.

My first post above discusses my position on this matter so I won't beat a dead horse here. Also being a customer is not a profession.

Date: 2013-05-16 01:50 am (UTC)
From: [identity profile] timelapsedecay.livejournal.com
Very well, but

Also being a customer is not a profession.
Being a professional artist is a profession, I was always ever referring to the OP who is an artist.

Date: 2013-05-16 02:19 am (UTC)
From: [identity profile] mekania.livejournal.com
Sorry I misunderstood, you were responding to post in which I was talking about customers.

Regarding the OP, it was a a bad choice to bring AB up just to say they wouldn't post at all but it's been over 20 days since they sent that message. I can understand changing your mind after being strung along even further.

I had the same situation happen a few months ago from this person. She wanted two wing-it slots I was holding as a special, sent me all the information for the characters. Said she would pay that friday, nothing. Went on back and forth for a month before I finally just wrote it off.

I am really sorry that this has happened to you too D: . I can't believe that she is STILL doing this and even using similar excuses. You did do great in handling this.

I had to post about her back last year because she owed me payments for 1 badge and 2 auctions (over $100), promised to pay and made up excuses to delay payment. She also did this to a friend of mine xc.

If she harasses you for posting to AB block her. (just as a warning from experience)

This girl seems like bad news. My advice is even if she does contact you with the money, don't take it. You've given her more than enough chances. Maybe try reposting the auction?

I'm glad she popped up on here again, she gave my friend an awful runaround on her sketch book auction; and the same thing with another friend on her YCH. ;c

My only experience was with an item trade, in which she never responded on it. So I brushed it off and never bothered with my half of it.

From: [identity profile] ciderfox.livejournal.com
Yea, I was the one who had a bad experience with her with nightlinez up there. She also said to us that she was in the hospital and that's why she couldn't pay. She freaked out and guilt-tripped us for asking for our money, it was nuts.

Sorry you had to find this out the hard way :< sometimes I wish there could be public FA announcements about clients like her, ugh.

From: [identity profile] marus-puppy.livejournal.com
This gal's eyes are bigger than her wallet... If even HALF of her issues are real (I'm currently assuming that she's making them all up to get out of paying when she realizes she just doesn't have the money) then she shouldn't be getting ANY commissions. Period.

I'm guessing she abandoned the account knowing she'd be posted here because of her reputation. Sorry you got dragged through this!

This is why i always have a time cap for payments. No matter the circumstance, if the buyer doesn't pay, then i hand the winnings to the next person. If that's not applicable then i'd delete the submission and try again.

Date: 2013-05-17 01:57 am (UTC)
From: [identity profile] puritikoneko.livejournal.com
This.

If someone doesn't pay up, I note the second highest bidder and ask they if they still want what they bid on. If not, I take it down and resubmit for another try. I only remind someone they owe me a payment once.

Date: 2013-05-17 02:22 am (UTC)
From: [identity profile] kasune.livejournal.com
So much this.
I don't have time to wait for payments. My cap is 24 hours, and then that's it. No payment, no slot, no commission. It goes to the next person who was interested.

From: [identity profile] staple-gunner.livejournal.com
yeah i've had an issue with her before when she won an art slave auction, we made a payment plan but she never paid and instead gave me excuses about having to pay rent and other family matters and it's like ??? if you have those obligations maybe you shouldn't be offering to pay me $250 for art.

it's better to just not let her participate in auctions, i guess because she RARELY ever pays what she owes. 8T

That's kind of what happened to my friend, she outbid everyone else to the point where no one else wanted to bid and then increased the amount to almost $300 :\ And THEN give her a nice little runaround.

She's done this to a lot of people, including myself. Sorry you had to deal with this, a flakey buyer just down right sucks.

Deleting comments in A_B is against community rules and would normally result in a warning and a reminder to read our rules before participating in the comm, however as you were previously suspended from the community and were on your last chance, I am placing a ban on this account.

I attempted to send this message via PM first however your privacy settings mean I cannot, thus I am posting it here.
