Text: WHO: HeavyPanda, WerewolfConfess, Henry(As posted on their DA)

WHERE: Stream Commissions, Initial interest was in an FA note.

WHAT: Digital art. $75 Flat color commission with a $15 discount, and a freebie thrown in as a gesture of good faith.

WHEN: Yesterday afternoon-ish. 6/10/2017

EXPLAIN: He came to me on FA expressing interest for a commission. I politely told him to hit me up in my stream if he'd like a commission, which he did. He gave me the info he wanted, I gave him the price, and he agreed to it. I did the artwork, and sent him a freebie as part of my promotion for yesterday's stream commissions and he thanked me. Later on, I find an e-mail from paypal saying that a chargeback has been issued, and I can't fight back with it because it's a digital good, and it was a nsfw picture. I do not have the conversation of our transaction cause it was in stream and I had turned off my computer a while after I was done to take a nap.

I tried contacting him through FA, only to find out that his FA account (HeavyPanda) has been disabled. I tried contacting him through DA (WerewolfConfess), only to find out that he's blocked me. I tried contacting him through e-mail; never received a response.

I've been trying to earn money all week to help pay for my medication for my eyes, and to help my husband cover the costs for a busted pipe that needs to be replaced in our house, and our sink replaced. So getting swindled out of my labor has majorly stressed me out.

That is beyond frustrating, I'm sure.

What's more is seeing how they're dealing with the comments on their DA front page. You can guarantee I'm immediately blocking and blacklisting this person. Wow.

No kidding. Looking at the comments on his dA, he's obviously trolling at this point to try and generate *more* heat on himself, claiming that he has a different side of the story that he refuses to explain. I guess this was some attempt to gain notoriety for... hell if I know what reason.

Really sucks. Sorry, OP. Beware well warranted.

I think we would all welcome him to explain his side.
Heck, I'm interested as to what on earth he feels could justify what he's done.

Now, I dont know if this helps at all, but when it comes to digital goods, I have always entered in the tracking info "Services Rendered" to complete the commission... would that help keep people from doing this and issuing a chargeback?

Either way, thats super sleezy that he did this to you.. Seems on his DA he is claiming there is a side to the story thats not being told... but seeing as he is unwilling to speak about that side, it is seeming iffy at best...

Well, he replied to one comment with "his" side of the story, which basically ammounted to him letting his nephew use his paypal, he had to leave & do work things, his nephew bought the comm from kayla, he came home & flipped on nephew, chargbacked & noted kayla, she didnt respond, so he decided to block her & deal with the concequences.
(Phone screenshots can be provided if needed)
I sort of call BS on this considering he made it sound like his nephew would usually only buy cards & stuff, so idk how he would have gone about buying a commission from an artist in stream.

I was just about to comment, took an archive if it if anyone is interested - https://archive.is/617ns

So very convenient that this mystery kid who just happens to also like Sonic and just so happens to be 18 so commissioning a nsfw pic is okay. And also just so happened to commission a picture of a hedgehog that he owns. Mhmmmmmm.

Sure a "nephew". About as believable as any other "my cousin/ sister/ brother/ roommate" did it. And even if it actually is the case, then he needs to recoup the cost from his "nephew".

I also find it funny it took him 4 weeks to notice his "Nephew" did this. His story has more holes then swish cheese.
Even if it was true why would the Nephew commission a character that dude owns and not tell him for 4 weeks not to mention think blocking someone is correct thing to do?

I feel no remorse for anyone who believes this story and backs him up, Beware well warranted and I hope others don't accept him.

Not to mention....your nephew was excited and PROUDLY told you that he bought Sonic Porn? That just doesn't make a lick of sense.

Never mind that paypal has a time-out, even if you left the window open in the browser, it would time out and you'd have to enter the password again to access it. Unless you let your browser save the password which, that's just unsafe, honestly. And that's before even getting into him commissioning a character the account owner owns, and not like, his own character.

(and if your nephew is real and 18 they can get their own Paypal account and bank account and learn some financial responsibility)

Wait, isn't it a SERIOUS breach of Paypal's TOS to knowingly let someone else use your account? Especially if said person is a minor (not that I believe this 'nephew' exists but let's pretend I do) and using it to illegally buy pornography. Because if he's not a minor, why doesn't he have his own Paypal account? That seems like the kind of thing Paypal might suspend an account for...

I took one of the full conversation, including his response to others: http://archive.is/EW1Pf

Judging by his responses to everyone, I think we're dealing with someone whose a few fries short of a happy meal, honestly.

I don't know what well-adjusted adult (even assuming the thing about the nephew is true) would just block Kayla-Na everywhere to avoid dealing with the situation.

And his comment "Besides, if she's as popular as some of you say she is, she can make that money back today if she wanted to. She could probably double it." is so flippant and frustrating.

Honestly, I think he just wanted his money back for one reason or another, yanked it back, then went into hiding hoping that by the time Kayla-Na noticed it'd be too late and he would have gotten to have his cake and eat it.
The fact that he is smirking in everyone's face who calls him out about it-- and constantly telling us about how funny it is to him and his friends makes me think he's hoping to achieve some sort of edgelord status or something for shrugging everyone off.

Like, dude. Just admit it, you were caught. Give the chick her money back. she earned it whether it was you or your 'nephew' that bought the commission.

I'm so glad that for once Paypal worked in the artist's favor and she got her cash back. x_x

Please be aware we have a rule regarding name calling and that you're toeing that line by referring to the bewared person as "a few fries short of a happy meal" and his mental capacity overall.

We're not the comm for it so please be careful with wording.

Thank you.

Oops!! Sorry about that. I tried to be as polite and gentle with my wording while still getting across my displeasure with this persons behavior.

I'll try not to let it happen again.

I've started to add "Digital" to all my invoice descriptions. I suggest either adding "Commission Stream- Digital Art Piece" as the title or adding it in the extra description. PayPal should side with you if the invoice clearly states that they are buying a digital good.

Best advice I can give.

Maybe it's the cynic in me, but what's stopping you from altering/changing a bit here or there to the image/character and selling it off?
It's a generic Sonic thing. After all, they aren't paying for it, no sense in them getting to keep it imo

Good luck in this.

(Swear. AB has given me books worth of reasons never to trust paypal. Just no security for the artist :/ )

Someone else actually suggested that on FA. It's not a bad idea at all.

My guess though is that she's giving them the opportunity to make things right, but that's just my guess.

I realized I'd probably never try to fight chargebacks either since all my work is NSFW. There isn't much that can be done to fix that either I think aside from avoiding paypal or using other venues. I'm not sure though, I never disputed a chargeback on my end.

It really sucks and thanks for sharing this info. I do Sonic NSFW as well and this is someone I would definitely avoid. I really hope you can have your money back in the end.

It seems to be becoming a trend now with people filing chargebacks after commissions are completed.
I keep seeing more and more about it and have had it happen 2 times now myself.

Seems to me either this person intended to scam or they used someone's PayPal without asking and the person found out and filed a chargeback.
Unfortunately dispatching optimism my best guess is it's the first option.

The best thing you can do in this case is dispute back. Present all the evidence you have here of the work rendered (censored if possible since it is NSFW) proof of their agreement, invoice, etc. Send it all in as a counterclaim on the case and PayPal will try to fight on your behalf. They need evidence of services rendered and such though if they are going to try and dispute the case against you.
Also show proof of the customer blocking you and refusing to respond as it will show them that while you're attempting to remedy the situation the other person is refusing.

Best of luck -- I can only hope PayPal will work to come up with a solution to this kind of exploitation as it is happening A LOT lately.

While I still find his attitude alone pretty bewarable (trying to act like he's the victim in this whole mess) and wouldn't take a commission from him because of it, I'll mark this as resolved for you.

If you are interacting with the subject of this beware on his DA page; please stop and refer to our comm rules.

Specifically:

2. Do not, in ANY WAY, contact anyone posted to the community if you are not personally involved in the transaction. We do not condone or tolerate harassment. THIS COULD GET YOU IMMEDIATELY BANNED!

This rule isn't just a "no trolling" rule; even just talking to them politely is not allowed if you're not involved at all.

Why does the invoice say tax on it? Is there any way to set one so it doesn't do tax?

Taxes are added optionally in the invoice template. Some states require they be paid on some types of personal services.

I like that you put taxes on your work. More artists should do that.

To charge tax where I live I need to be registered as a business and file for a tax code, and provide it when asking for tax.

Legally I dont not qualify as a business by our tax standards, as rendering a service =/= business. So kinda moot to charge tax where I am.
